The United States signed on to an international arms control treaty Wednesday that seeks to reduce global atrocities, but the road to ratification in the Senate may prove to be extremely bumpy and, possibly, insurmountable.
Secretary of State John Kerry signed the United Nations Arms Trade Treaty (ATT) on the sidelines of this week's gathering of the U.N. General Assembly.
The treaty, which nearly 90 countries have signed, requires signatory countries to ensure arms are not sent to countries where they could be used to commit genocide, crimes against humanity or other serious human rights abuses.
"This is about keeping weapons out of the hands of terrorists and rogue actors," Kerry said as he signed. "This is about reducing the risk of international transfers of conventional arms that will be used to carry out the world's worst crimes."
But with the treaty requiring the consent of two-thirds of the Senate for its approval, the battle lines back in Washington were sharply drawn even before Kerry put pen to paper on behalf of the United States.
Several influential and powerful Republicans voiced their disapproval in letters to the Obama administration.
Sen. Bob Corker, R-Tennessee, ranking member of the Senate Foreign Relations Committee, said the treaty "raises significant legislative and constitutional questions."
Corker, in a letter addressed to President Barack Obama, warned Obama against taking any executive action to implement the treaty because, in his view, the treaty required changes to United States law through legislation passed by both houses before it could go into effect.
"Various provisions of the ATT, including but not limited to those related to the regulation of imports and trade in conventional arms, require such implementing legislation and relate to matters exclusively reserved to Congress under our Constitution," Corker wrote.
An even greater threat to the treaty's prospects in the Senate was echoed in a letter from Sen. James Inhofe, R-Oklahoma, to Kerry. Quite simply, the votes for the treaty's passage are likely not there.
In an amendment to the budget resolution this March, 53 senators voted for an amendment sponsored by Inhofe preventing the United States from entering into the treaty. Eight of those votes were cast by Democrats - some of whom face a tough 2014 re-election climate in states that traditionally tilt Republican.
Inhofe, ranking member of the Senate Armed Services Committee, said such treaties "threaten our country's sovereignty," and warned the treaty would "collect dust" alongside other U.N.-sponsored treaties such as the Kyoto Protocol and the Law of the Sea Treaty, which were never voted out of the Senate.
While the United States is currently locked in a passionate debate over gun control legislation following several mass shooting in recent months, international events however seem to be the driving force behind the administration's push for the treaty.
As the bloodshed and violence in Syria's civil war show no signs of abating, the Obama administration is signing the treaty in part to apply pressure on Russia to cease its arms sales to the regime of Syrian President Bashar al-Assad. The treaty was adopted earlier this year by the General Assembly, but Russia, and Syria's other major supporter at the United Nations, China, has not yet signed on.
But detractors to the treaty see a threat to individual American freedoms hanging in the balance as well.
"The Obama administration is once again demonstrating its contempt for our fundamental, individual right to keep and bear arms," Chris Cox, executive director of the Institute for Legislative Action at the National Rifle Association, said in a written statement.
"This treaty threatens individual firearm ownership with an invasive registration scheme," Cox said, adding the NRA would continue working to oppose Senate ratification of the treaty.
Among the concerns of the NRA are the treaty's inclusion of small arms and light weapons within its scope, which the organization says include those same types of arms owned by law-abiding American citizens. The NRA also opposes the treaty's call for the retention of data on end users of imported firearms.
As he signed the treaty, Kerry sought to dispel those concerns by saying the United States would "never think about supporting a treaty that is inconsistent with the rights of Americans."
"The treaty recognizes the freedom of both individuals and states to obtain, possess, and use arms for legitimate purposes," Kerry said. "This treaty reaffirms the sovereign right of each country to decide for itself, consistent with its own constitutional and legal requirements, how to deal with the conventional arms that are exclusively used within its borders."

In reality I support the 2nd Amendment, but find the NRA and some of the other groups distorting what the Founders actually passed.
These promoters don't see that the rules as they are now, allow the gangs to arm themselves. Simple rules like being a registered voter to buy firearms could stop the flow of arms to these people.
The OBama Administration is solely responsible for driving the profits of the gun manufactures due to the emotional knee jerk reactions with trash such as the AWB, Toomey-Mancin etc. Obama will be known as one of the greatest arms salesmen of all time. Until you cement heads finally realize, criminals don't follow laws and will get guns no matter what. But some still like to be the sheep and are unable to take care of or fend for themselves. We get everything we want. Gun show loopholes closed. No more trading or selling weapons between individuals. An assault weapons ban. A gun registry and massive heavily enforced regulations on all gun brokers.
I don't know if anyone has actually looked at the "Treaty", but there are a number of items outside of our 2nd Amendment rights...like providing money, material, and/or MANPOWER to any signatory country trying to enforce the treaty. Or how much MORE money we're going to shell out to the UN to implement and maintain this mess. Anyone that thinks this treaty is a good thing needs to understand that there is nothing to our benefit in this treaty. We already have extensive laws governing the import and export of weapons and ammunition...and that still didn't stop Iran/Contra, Fast and Furious, or arms in Libya. Internationally, it didn't stop France and Russia from supplying Iraq advanced military tech during the embargo during the 1990s.

US arms manufacturers are actually exporting small arms to these regions. That's why the NRA rejects the legislation. Dennis there really hasn't been any crimes against humanity or genocide in the US in the recent past if I remember correctly.

I think this is a good treaty worthy of signing, but I also can see how there is no way the Dems and GOP are going to sign on to this.
First things first. This is not an anti-2nd Amendment treaty folks. So you can leave your stupid Anti-gun and Pro-gun signs at home. The issue of this treaty is the sale of arms between nations and foreign factions. This treaty will not make it illegal for you to buy guns. It will however make it illegal for the government to sell guns to terrorists and dictators.
This brings us to our second point. This treaty is good because it is in both our sovereign national interest and in the interest of the World to not give weapons (most of which Americans cannot even buy themselves) to what is essentially our enemies. However this treaty will not pass the Senate because it conflicts with interests of Both Parties. If this treaty were ratified then McCain, Obama, Hillary, and Bush's plans to arm the Syrian Rebels automatically become invalid and illegal. Furthermore that 1+billion dollars the the Dems and GOP give to Egypt annually will also be gone as they have used that military hardware to massacre their own people just two months a go. Pakistan's annual allowance would also have to slashed, a good amount of the African and Middle East countries would ultimately lose their funding. The Dems don't want this because the Dems want war, even Hillary whom is no longer in politics is all gung-ho to start some more wars and suffering and has made many public statements to support this. The GOP obviously doesn't want this as the FSA is McCain's little pet project and a lot of their 2016 champions, except for Rand Paul, pretty much all espouse the same pro-war rhetoric as Hillary and Obama.
We should stop giving weapons to terrorists and dictators. If not for the obvious humanitarian reasons, then at least for the reason that these dubious factions tend to backstab us and become our next big national security concern. Also we should stop giving these countries so much money and weapons when our own nation is so broke from frivolous Dem and GOP spending that we might not be able to give our own sovereign military their well deserved pay checks. Unfortunately the Dem and GOP Leadership just wants war and they are paling around with terrorists and dictators around the World. So until we have a REAL change in Leadership in Both Parties, our country is just going to keep making the same mistakes that every failed Empire in history has made. This Treaty should be passed, but with the Leadership of Both Parties so crooked and bent on warfare, I highly doubt it will get signed.

Well see that's a different debate entirely. And it is pretty irritating the NRA has jumped into this debate thus bringing its followers and detractors with it. The issue with this treaty is not Second Amendment Rights. It is whether or not we should be giving weapons, much of those weapons Americans can't even buy even with the Second Amendment Rights, to non-state actors or states which commit humanitarian atrocities. Unlike the Gun Debate in America, this Treaty and this issue at hand is actually pretty straight forward.

The reason the NRA got involved is because of the non specific wording of the treaty. Wording that was not clarified and is left open for interpretation. That wording in the treaty could be used to conflict with the 2nd Amendment. The NRA supports the individuals right to bear arms. The biggest buyer of weapons and ammo is the United States government and they don't need the NRA to get weapons of any kind. If you think that Russia and China would not step up production to fill any weapons needs you are the ones who need to pull your collective heads out of the sand.
Well, hopefully because of this treaty that Eric Holder will be prosecuted for his participation in providing weapons to Mexican cartel in "Fast and Furious." Probably not.

So now the NRA's ability to produce and sell weapons is more important than working for world peace? Why don't we just make the NRA a third political party in this country and have them elect their own senators and representatives – oh, wait.. . .we've already done that.
