Is Ft. Hood suspect physically fit enough to be his own lawyer?

The judge hearing the court-martial of Ft. Hood massacre suspect Maj. Nidal Hasan has ordered a medical evaluation to determine if the Army psychiatrist is physically fit to act as his own attorney.

Col. Tara Osborn noted at a hearing on Wednesday that a prior examination determined Hasan was mentally capable of conducting his own defense in his murder case stemming from the November 2009 shooting spree at the Texas military base.

But she ordered a doctor to administer an exam to see if he can hold up physically if he were to represent himself, according to a statement.

Hasan was shot and paralyzed from the chest down on the day of the massacre in which he is accused of killing 13 people.

He said last week that he no longer wanted to be represented by the military attorney assigned to his case. Hasan fired his civilian attorney in 2011.

There will be another hearing on Monday to review the medical results.

Jury selection is slated to begin next week.

Hasan, who is entitled to be represented by a military attorney at no cost, has retained his rank and pay while in custody.

It is standard procedure for a member of the military accused of a crime to receive pay while a case is being decided.

Pay records show Hasan has earned an estimated $280,000 during that time.

      If he was indicted for treason he could not have continued to receive his military salary while awaiting court. However, since his arrest, he has received about 280,000 dollars in military pay, which he is free to donate to Muslim programs that have not been formally declared as terrorist organizations by The US State Department. You should look into CAIR, The Counsel on American Islamic Relations. They are considered tepid by our government, but their actions are outrageous

    Did any of you people here ever consider why this man did what he did? Put yourself in his place for a minute and imagine that you're a Muslim and you see people who believe the same way you do and speak your language. Then imagine seeing these people get slain like animals by those drones and Apache helicopters from far away. Although not a Muslim myself, even I get quite angry at what's going on!

One would think that if Hasan wanted to protect Muslims for harm, he would have wanted to fight the Taliban and al Queda.

      I wish to disagree with you here, Jomama. This man's life is not in fact over, I may be harsh in what I've written, but his life continues, the lives that are over for the 13 individuals who's lives were taken by him on that horrible day four years ago. Its better not react with dire wishes to see this man suffer and your right let justice takes its course. Although those 13 lives that were taken by him have a complete ripple effect on their families that will be felt for generations, and I don't think I'm saying that wrong, you have mothers and fathers, grandparents and probably hundreds of relatives effected by this man. Who absolutely is a traitor to fellow corp men and his country. I have no idea whether or not he will face the death penalty, but right now he's been on this earth four years longer than those he killed.

    As a former officer who served 2 tours in Vietnam before I was severly wounded,
    I donot understand why the U.S Military is wasting time much time and effort for this
    TRAITOR. There is no doubt the Majors Guilt.Just do a simple Court Marshal
    find him guilty then take him out, stand him up against a wall and have a 6 man firing squad
    And execute him for Treason.

      This is dragging along for so long so he can continue to get his Major(O-4) pay. Once he is convicted that pay stops. But where else does your employer keep paying you for not working and in a jail cell. Wonder if he is trying to drag it out till he can retire.

    Funny, the article does not say the reason he gave for doing what he did. He was very vocal about it at the time. Very proud of why he shot and killed so many of his fellow soldiers.
    And WE have paid him $280,000 during this time. Just great.
