Holder: Drone strike against Americans in the U.S. possible

Attorney General Eric Holder Tuesday stopped short of entirely ruling out a drone strike against an American citizen on U.S. soil—without trial.

Holder’s comment came in a letter to Sen. Rand Paul. Paul had sent a letter to President Obama’s CIA director nominee John Brennan asking for the administration’s views on the president’s power to authorize lethal force.

In the letter, Holder said “It is possible I suppose to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States. “

In a separate letter, Brennan told Paul that the CIA has no such authority.

The nomination passed its first hurdle Tuesday with the Senate intelligence committee voting to approve the nomination in a 12-3 vote. Republican Senator Saxby Chambliss of Georgia said he voted against the nomination because of inconsistencies in Brennan's testimony.

Earlier in the day, the White House agreed to provide legal documents written by Justice Department officials explaining the legal rationale for  targeting Americans overseas who are involved in terror-related activities that threatened America or American interests.

Holder is incompetent, imo. His responses to Fast and Furious demonstrated that. His reply to Paul here was six ways stupid, politically. That said, this is a non-issue, by and large. The Admin is not asserting an unfettered right to arbitrarily kill any U.S. citizen at any time. And ultimately, Holder is right: there are conceivable–though unlikely–situations wherein a President might authorize the killing of a U.S. citizen on U.S. soil. All involve war of some type; none involve the dinner table.

open border libertarians who invited millions of muslim colonizers are now worried about drone strikes on US citizens.

this is not an ideological battle between left vs right, GOP vs Dems, Statism vs liberty, socialism vs free markets. This is ethnic warfare against white people.

Why are hostile globalist elite supporting Israel as a Jewish ethnostate with Jewish only immigration, but turning white majority Europe, North America into a multi-ethnic multi-cultural Gulag with dystopian non-White colonization?

Why do gullible Whites kowtow to hostile Jewish elite, who maim White soldiers in bankrupting wars, infiltrate and subvert our central banks and intelligence agencies, indoctrinate us in classrooms and mass media, impose trillions in debt, and plunder our wages?

East Asia is 99% yellow. Africa is 99% Black. West Asia is 99% Brown. But 3rd world colonizers are annihilating Whites, just as Chinese colonizers are annihilating Tibet. This is the endgame.

"Native" Americans are not native. They invaded from East Asia. Whites were not the only slave owners, imperialists. Muslims, Jews, China, India, Mayans, Africans all are guilty of slavery, imperialism. Whites were victims of Arab, Jewish, Turk, African, Mongol imperialism, slavery.

Gullible Whites should reject suicidal anti-White Jewish ideologies like libertarianism, feminism, liberalism, socialism. White people should reject venomous smears of racism, collectivism.

Love to all, hatred to no one, but White people must unite and organize to advance their families, their fertility, their interests.

Because in most instances at the time they are playing that roll, the cop or soldier has a gun pointing in their face and it's kill or be killed. The president gets to mull it over and then have someone else do it for him. Just sayin...

Finally we can all send drones to the air to do as we wish. I've been looking forward to this, lets all be judge jury and executioner on this concept. Flip a coin if in doubt on the kill. We as citizens follow the path of the government (as though we have a choice) its open season on any target now.

Eric the dow is at a record high, but that hardely represents the economy. Record amounts of people are still currently out of the workforce, record amount of people are on government assistance, and the average salary of the middle class is going DOWN. 30 companies that do well really well does not represent the state of things. Obama DOUBLED the deficit, 4 years in a row now, at most bush shares the blame for one year of it. Since tarp has nearly been payed back, there is no excuse for an informed person to blame anyone but Obama and the legislature.

Obama didn't double the debt. The problem is, and continues to be, the economists are neoclassicists, except for a few like Paul Krugman. In economists' models, they do not take into account private debt! That is what caused the collapse. First, it is private debt by investors that is pushing the DOW higher without any increase in jobs or productivity. There is a complete disassociation between real productivity and money supply. The debt did not increase under Bush and Obama, the Feds bought the debt, made it a public debt, but the debt was there all along. The debt incurred by Obama's stimulus package was too little but what there was of it is good debt, as it went into production, not into stock market manipulation. The housing collapse was housing inflation caused by incurring loads of private debt which had no floor based on actual US productivity.

The problem for Obama, and any President is that 40% of the economy is fake, based on money chasing money, not money being used to create jobs and increase productivity, and the typical economist is feeding flawed economic theory to the President. That would happen to any President. That is, 40% of the US economy is the financial industry. When the US had a solid economy, the financial industry was between 5% and 10% of GDP.

I don't think any President would make an economic decision that would go against the economic models that are pushed by 90% of the economists. I think Krugman is the only well-known economist that sees both the long term and short term problems, and he is in the decided minority. But, at least in the short term, we are not being a patently stupid as the Europeans, who are trying to come out of a recession by austerity. The result is Italy is collapsing, Greece is collapsing, Spain is collapsing, and more will follow until the Eurozone itself fails. Europe is like a family with too much debt, but instead of going to work to pay off the debts, they decide stay at home and to stop eating to save money.

The Fed has increased its balance sheet to $ 3 Trillion by buying US Treasuries that China no longer wants to but due to our outstanding debt obligations and also because helicopter ben bernanke is having the FED purchase mortgage backed securities at unprecedented levels. It is easy money for the banks at the FOMC window who get the money first at ZIRP and the fed pays interest in turn to the banksters for the US Treasury to be able to fund the out of control govt. spending, the increase in the money supply causes two things that are extremely damaging 1) malinvestment by banks who buy risky derivitaves, because they are to big to fail and our backed by the govt.and 2) the creation of asset bubbles
also the increase in the money supply at historic levels chasing the same amount of goods creates the insidous hidden tax known as inflation that we are witnessing at the pump and at the grocery store.Bernanke states that the FEDS goal is twofold to lower unemployment and to keep inflation down Bernanke the banking cartels puppet has failed miserably in his stated goals while enriching Banksters of the cabal .

        March 6, 2013 at 1:41 am |
      • Larry Winkler

There is not out-of-control government spending in the way you are saying. The problem is the government is trying to keep the economy alive at the same time it is being destroyed by the financial industry itself, and trying to buy time for the anemic productive economy to grow enough to support the collapsed roof the government is trying to hold up through public debt. The Fed, aside from flawed economic theory, is the only game in town, who has the power to keep any money flowing into production. The Republicans want to take the economy to full collapse like Europe, and Obama cannot move a stimulus package into place because of that. In addition, Republicans governors are doing their share to collapse the US economy by creating fake austerity problems at the state levels. If the Congress had any sense, and it doesn't, then a new stimulus package to increase productivity would relieve the Feds from buying the debt to keep the economy afloat. The increased productivity would be available to pay down the debt instead of hiding it at the Fed.

The U.S. government declares a ban on the possession, sale transportation, and transfer of all non-sporting firearms. A thirty (30) day amnesty period is permitted for these firearms to be turned over to the local authorities. At the end of this period, a number of citizen groups refuse to turn over their firearms. Consider the following statement: I would fire upon U.S. citizens who refuse or resist confiscation of firearms banned by the U.S. government.

What is the purpose of scrambling F-16 when there's a threat in the air? If a plane is heading towards a densely populated city, knowing that some terrorist have control of it, wouldn't the F-16 just shoot it down, with hundreds of American Citizens on board? F-16 or Drone, what is the difference. This policy has been put in place before and n one is complaining.

The two parties are two sides of the same coin.. All of these are irrespective are being carefully implemented one by one for something perhaps planned. Y'all are getting your panties in a twist over a lawyer postulating a hypothetical situation as an intellectual exercise. I can imagine the government killing Americans without trial every day – legally. When a cop shoots and kills a criminal who poses an imminent threat of bodily harm to others. That "hypothetical" doesn't sound so loony, now, does it? But when Holder says he can imagine a legal use of such force, you immediately go to "gunning down babies with machine guns."

ThruiIt2 all POTUS have held this power its not new to Obama.

A situation like a military revolt, or if a foreign power landed troops and equipment on our soil for use by US citizens, or like in the 1860's a confederation of states banded together in rebellion against the federal government. There are numerous scenarios, unlikely as they may be, where the POTUS could find it necessary to deploy US Armed Forces within our continental borders.

This article is pointless, its not reporting anything new. Its just making uneducated people with low functioning mental capabilities think President Obama is some kind of bad person; where as in reality every president since George Washington has held this authority.

Most everybody big and dangerous gets called "terrorist" nowadays. If you're a criminal, then you're anti-social, if you're anti-social then they can say you're against your country, and if you're against your country then you're called a terrorist. Soon enough the drone policy will be unleashed against all sorts of "undesireables." You can foresee the government excuses. "Well, we sort of, kind of, maybe thought he was going to set off a stink bomb in the post office, which would have been a federal offense if he had done it, and nobody liked the guy anyway, so, yeah, sure, we took care of business and droned him."

Since when would the US government be bothered to put their own citizens in harms way or outright kill them? Have you all forgotten 9/11? That was a staged terrorist attack perpetrated by the government (Georgia Bush during her first term). The supposed suicide pilots who flew into the Twin Towers, who were found alive on 9/12/2001. What about the drone that hit the Pentagon on 9/11? or the flight that disappeared in Pennsylvania???

Folks tend to forget that BUSH was in office for 8 years and managed to run the entire earth into the ground in less than 4 years...And we're still feeling the effects of it, although he has been out of office since January 2009. The election was in in 2008, but we were already in a recession and the housing market crash was long before that election. BUSH!!!

Paranoid, eh? DHS wants to buy more than 1.6 billion rounds of ammunition, buys 2700 assault vehicles. Our government has proposed rules to expand the military’s use inside U.S. borders.

“There are currently more than 70 different federal law enforcement agencies employing over 120,000 officers with arrest and firearms authority, according to Bureau of Justice Statistics data for 2008...That’s an increase of nearly 30 percent between 2004 and 2008. If the trends have continued upward at a relatively steady rate, that would put the total number of federal law enforcement officers at somewhere between 135,000 and 145,000.

That’s a pretty staggering number, especially when you consider that there are only an estimated 765,000 state and local law enforcement officers. That means that about one in seven law enforcement officers in the country works directly for the federal government, not a local jurisdiction.” – Jeff Knox, director of The Firearms Coalition

      • foulkeblows

Umm, your numbers are low. If the rate of increase you cite (30% in 4 years) continued unabated – that means without slowing down – the numbers would be about 156,000. Rock Lobster!

We know that in some cases, the FBI or police will kill someone without due process (Dorner, the guy who kidnapped the kid from a bus, etc). They have to pose an imminent threat to someone else's life. So drones could fit into that formula. But I would be concerned about a slippery slope on the concept of "imminent"

The law enforcement agencies had no intention of taking Dorner alive. One of them was hoping to mount Dorner's head on a trophy. The last cop that tried – died. Once they realized that wouldn't happen, they torched him. Sorry cops – no trophy for you!!!

Your scenario is DUE PROCESS. Due process does not mean Miranda rights, jury trial, lawyers present, a judge. If someone is about to kill another, due process does not even include the right to be told to stop it or i'll shoot.

Because the police are governed by the rule of law, need warrants to go after someone, and are answerable to the people they provide services to.

This is the federal government using tools of war against US citizens without any due process. BIG difference.

There is no indication that the government is arming the drone with the same armature as used in combat situations. Or, to turn things around, there is no law that prevents a swat-team, or anti-terrorist team to use rocket-launchers in their assault at this time as well...

Have you ever seen what I drone can do? If you haven't let me illustrate it for you. A drone can, and was originally designed and deployed to be a surveillance tool. Shortly after those first deployments they were weaponized. There are very few alternatives available for drones aside from rockets or guided munitions. These are not precision weapons, they are essentially bomb delivery vehicles with surveillance capabilities.
Additionally, there is a big difference between a SWAT team going through due process and obtaining proper, established civilian authorization for a raid and Homeland Security tossing rockets at someone without any oversight that we can, as citizens, be a part of.
I would like you to imagine for a moment, that you live in an apartment complex, condo, duplex, even a neighborhood with homes very close together. Now imagine that your neighbor is targeted by a drone...and you happen to be home with your family. If they decide to "pull the trigger" on your neighbor, you are going to be affected severely. Hopefully it will only amount to loss of property, but many people in the middle east and certain other countries can attest that not just the "guilty" are "brought to justice" by drones. This is coming from someone that has seen this kind of thing up close and personal.
I hope that this makes sense to you because it is entirely too important to ignore or allow. This should not be happening within our borders, ever.

        March 5, 2013 at 8:53 pm |

If we have a revolution, an 'american spring' if you like, then the people we put into power will just turn around and do the same thing or worse to us that the government we deposed used to do. Look at the middle east. it is an unlivable quagmire of nonsense after their 'revolutions'. maybe they needed their dictators because it turned out they're too stupid to to realize they're all in the same boat.

Agreed. This is an American issue and a very serious one. Party affiliation makes no difference here. The military is here to protect the citizens of the United States, never to be used against them.

What is the difference in scariness whether the airplane has a pilot or is remote controlled???? It would be way more scary if there is an extraordinary situation (say 911) and the government would be prohibited to respond with force...

Congress does not interpret laws. They write them. The executive executes them, and therefore interprets the laws to fit the facts under consideration. Courts get involved only if there is a case or controversy, and occurs after the fact.

Read Holder's statement carefully: he spoke of the possibility and not the certainty, and only under extraordinary circumstances would the U.S. Govt use a drone be used to kill an American citizen whose actions can be construed to be treasonous, such as Al Awlaki. I believe that was a justifiable action.

The psychopath David Koresh and some of his Branch Dravidians were criminals and it can be argued that he would have continued to do great harm to some of his acolytes (think Jim Jones) if he had survived. He and his henchmen executed most of the Branch Dravidians in Waco, not the U.S. government, although, in hindsight, the government should have exercised more patience and wait this thing out (what was it? over 58 days?) so that more or all of the people could have been set free through negotiation.

If Republicans ruled this administration, you can bet they would have supported a tougher support for drone killings. The Red party is a sanguine lot, worse saber rattlers, and believe in a more militaristic approach to things. The hypocrisy of it all.

It isn't as if Al Awlaki or his others are actually on U.S. soil doing their plotting against the U.S. I hope that a drone doesn't come zeroing in on your home one day and the only response we will get from the government is "oops! our bad!"

Yes, they are, or at least that are the plans recently made public and sent to Congress. And the US is the least vulnerable of the Western powers. France, England, Germany are far less secure.

As for US concern about North Korean and Iran and Afghanistan, ability to smuggle small nuclear devices into the US via the billions of tons of goods ship into the ports on ships, makes your idea of security quite naive.

        March 5, 2013 at 9:16 pm |
    • MrNeedtoKnow

Dan, why do you justify and agree with Holder? He should never said that. Just the thought of using a drone against an American citizen in American soil just because the government labels someone a terrorist it doesn't make it okay to kill someone. The government is the biggest liar and the biggest tyrrany.

It's okay since you are left wing and your ideology is 100% correct at all times, you get what you deserve. Make sure that you don't do anything wrong at all, or you may be labeled terroist. Keep your eyes down you don't want to see death before your eyes.

Holder didn't say anything about killing a American on American soil just because the government has decided to label them a terrorist. His examples of potential use of drone were examples of an active active: Pearl Habor, 9/11.

And, as for labeling Americans in Afghanistan as terrorists then taking them out, you seem to be quite idiotic. Those the US took out were planning and executing training and bombing of American soldiers in Afghanistan. Really, what kind of traitor are you to suggest that we allow someone to attack our military in the midst of a war.

I think you are missing the point. If you had sent a drone to kill David Koresh or Jim Jones you would have still killed innocent people. Every person deserves their right to free speech, but if they are killing people, or intentionally harming others they still deserve the right to a trial. Most criminals killed in a shootout are dead because they are shooting at law enforcement. The drone it taking away any rights the "target" has even if they have not fired upon anyone, just because they are identified by someone who does not like them as a target. This would be the same as placing a remote triggered bomb on their vehicle instead of arresting them.

I think Eric Holder needs to read the 5th amendment. It clearly says that they can not take your life, liberty, or property with out due process of law. So unless the person has an RPG, or a bomb strapped to him self and is in the process of carrying out a terrorist act, The government better think twice about killing Americans. I don't care who's President, Bush, Obama, or Mickey Mouse.

Yes what holder said was applicable to imminent threat cases, he didnt say they would do it randomly on people. You'd have to have to be in the process of carrying out an attack.

Yeah... That makes no sense, Yes people have been executed for treason. After they where convicted, whether by court-martial in the military or in a civilian court. The government can not take your life with out due process of law( 5th Amendment). The only exception to that is if you are in the process of carrying out an act, that will result in the loss of life. A cop can not just shot you because he thinks your going to commit a crime, You have to be an imminent threat to the public or himself.

Why should they be banned? Military already has the authority to shoot down planes over secure airspace. Instead of sending up a jet with a pilot onboard, what's the problem with using a drone. Of course, it doesn't have to be a war-grade drone but one designed for such a special purpose.

Much ado about nothing! If a drone was the only weapon available to stop an imminent attack on innocent people, go ahead and use it. People generally don't see a problem with a police sniper taking out a suspected criminal who is holding a hostage. If military fighter jets had been able to shoot down the airliners before they hit the WTC on 9/11 I think most people would have agreed it was the right thing to do. Would we be crying that they didn't get trials first? If a drone strike in the final moments could have prevented McVeigh from detonating his bomb in OKC would you say don't do it? Holder was just answering a hypothetical question about whether there could be any situation where a drone could be used against American citizens in the US. He wasn't proposing any change in the law or saying we could use them for executions. A drone is simply another kind of weapon, and who knows maybe it could be the right weapon for the job in some crazy scenario, so Holder was right in not completely ruling out the possibility.

You've got to be kidding? Taking out the 9/11 planes before hitting the towers, and everyone would agree? Frankly, I can't imagine a worse scenario for a person, President, or some lesser official to give the order to shoot these planes down, knowing you would be ordering the killing 100s of wholly innocent people.

Yes, that would have prevent the deaths of thousands in the Towers, but still, if you think such a decision would be easy, you've been seeing too many tv shows, and playing too many video games.

As much as I fully disrespect every aspect of Bush/Cheney's reign of terror, I cannot image anyone who would find the decision easy. Perhaps the only recent President that would truly understand such a decision would have been Eisenhower. and before that Grant.

It's really scary how damned stupid most of the commenters are. There has never been a time where the police have not had the authority to kill an American without a trial. Where did anyone get the idea there ever was? Any cop can kill an American without trial if the cop fears for his life. Unless you really think that States have and should have more authority to kill Americans without trials than the Feds, then there really isn't an argument.

Secondly, though, in theory, the US military is restricted in the use of force on American soil, the FBI is not. And with the authority given to Homeland Security (and pretty much everybody agrees coordination of counter-terrorism units with the Federal and State governments is necessary), the expansion of quasi-military forces in the US is simply going to have authority, regardless of the tools it happens to use.

Stop the asinine push-button responses to the word "drone". That is all most commenters are going berserk over. It's just the tool Rand Paul is fixated on. He's just another mental midget the Republicans continue to elect.

So are their lives less important then what MAY have happen? Remember hind sight is always 20/20, prior to an event how does one KNOW without evidence what is actually reality, not just a message.

Drones have been budgeted for and researched over many administrations with full Congress approval. They didn't just appear magically when Bush became president.

John S. Where did you get the idea that use of drones will require either military or presidential authority? States and local authorities are requesting the use of drone technology themselves. I'll tell you now, I'd prefer the authority of use deadly drones to be solely under the authority of the POTUS, than some State or local clown. Wouldn't you?

        @MrNeedToKnow,
        You said,

"and the left wing nuts aggressively use them and now in our soil. "

Yes. They've aggressively used them against our terrorist enemies, and very successfully.

        "and now in our soil"

No they don't. Name a time, one time, one victim. Here, I'll supply the right wing rhetoric for you:

Obama can use drones against us! Therefore he WILL use drones against us! Rush Limbaugh says so! Fox says so!

Never mind that the technology was present since before the days of Bush the Elder and Bush the Younger. You think this new magic announcement by Holder means they couldn't have done the same thing?

Yes, you really do NeedToKnow, mister. Think "Ruby Ridge". That was Bush the Elder's operation, despite Limbaugh's attempts to assign it to Clinton. Bush the Elder didn't use drones in that case because he didn't have to. He had a crack team of right-wing gun-nut snipers who could do the job in only a few cheap shots at unarmed citizens in their own house, plus expenses for a few nights in Vegas after a "job well done."

You own the spin and rhetoric. You own Ruby Ridge. You own Drone technology, and you the presidential arrogance to use it and any other weapons he chooses against the citizens of the United States.

Obama doesn't have a Ruby Ridge. Do the math.

Hysterical. Bush runs this country into the ground. Reagan and the Bushes create the MASSIVE deficits that got us into the hole in the first place, and perpetuate the same GOP mindset that created the Great Depression, and Right Wingers fawn over these guys while demonizing Obama. meanwhile, the auto industry has survived, we got out of the economic tailspin of the Bush Admin, the Dow is at near record highs, Big Business is more successful than it has EVER been. And again, Obama gets demonized because he thinks the Rich & Powerful need to stop hoarding the wealth. James, you are looking in the mirror.

Dow at 700 and diving when bush left office. 5 years later a black man has returned the dow to record levels. How are those apples you old, angry, and tired republipunks? Love it.

        @Bob,
So what? Bush the Younger was in office for 8 years. You give Obama a failing grade because he hasn't fixed 8 years of financial ruin and the aftermath of the 9/11 terrorist attacks in 5 years? Wake up Bob. Even 5 years of hard work can't make that result of gross incompetence go away.

Try to open your mind past the number "5". I doubt you can do it, because Rush Limbaugh is telling you not to do so – and you obey, a good little obedient pet.

The USA has had the ability to do everything described by Holder at least since the days of Bush the Elder. Did you complain about "big government" then? Why not? And what about Obama? Why didn't he fight against the Bush family's capability, exactly the same as the capability Holder claims Obama has?

Oh, that's right. He wasn't there. Well, it's all still his fault anyway, because Rush Limbaugh and Fox News says it is.

"Ruby Ridge" – Bush the Elder

        9/11 – Bush the Younger

Economic disaster – Bush the Younger

You awake yet, Bob? The answer for you: Algebra 101.

Where does this idea that Bush ran the country into the ground come from? You do realize right that the housing market collapse for instance is the result of policies enacted during Clinton's administration right? All these deals with China and the outsouring etc. happened under Clinton as well. The U.S. economic recession is the result of policies enacted decades ago that caught up with the changing world.
