Holder: Drone strike against Americans in the U.S. possible

Attorney General Eric Holder Tuesday stopped short of entirely ruling out a drone strike against an American citizen on U.S. soil—without trial.

Holder’s comment came in a letter to Sen. Rand Paul. Paul had sent a letter to President Obama’s CIA director nominee John Brennan asking for the administration’s views on the president’s power to authorize lethal force.

In the letter, Holder said “It is possible I suppose to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States. “

In a separate letter, Brennan told Paul that the CIA has no such authority.

The nomination passed its first hurdle Tuesday with the Senate intelligence committee voting to approve the nomination in a 12-3 vote. Republican Senator Saxby Chambliss of Georgia said he voted against the nomination because of inconsistencies in Brennan's testimony.

Earlier in the day, the White House agreed to provide legal documents written by Justice Department officials explaining the legal rationale for  targeting Americans overseas who are involved in terror-related activities that threatened America or American interests.

      Now the same people championing the Patriot act are now concerned that their rights are being violated? THEY might be droned?

      ...HUGE difference between an imminent threat and murdering a person who is not an imminent threat and is certainly not -proven- to be an imminent threat to anyone.

      Al Awlaki was not shown to be aiming a nuke at DC (or anything remotely like that), and his 16-year-old son from Colorado, who was separately targeted and killed, most certainly wasn't.

    wow... drone strikes overseas are a gray area, then against a US citizen overseas brought it further.

    this though is flat out insane. does obama just think he can do anything he wants and ignore his actual duties (and as i type this i realize how obvious that sounds)? and yes, i'd be scared of what a republican pres would think about this too. while hardly worse than castro, this needs to go.

    as for holder, it's even scarier because this isn't even as bad as it gets for him

      Obama's administration has killed hundreds more "combatants" and innocent bystanders with drones than the "warmongers" in the Bush administration ever dreamed of killing. Even the NYT has reported on this insane irony. Since the Obama administration refuses to articulate its drone assassination policy, it's entirely plausible that Americans in the U.S. could be targeted eventually.

    One of the problems with Drone strikes on American soil will be collateral damage. We'll have drones killing 70 people at a wedding because the drone recognized 1 guest as a terrorist. I'm sure you've read about these drone strikes overseas and they don't always hit their intended target.

      I find it amazing how you don't see the very IDEA of a drone attack ANYWHERE in the world as cowardly and dishonorable. A war is only a war when both side know they are being engaged. Drone attacks are assassinations, and cowardly ones at best. Drone strikes remove all thought and emotion from the "soldier" perpetrating them. All the operator is doing is pointing a gun and shooting at a target from miles, maybe a continent away with no knowledge of why he's doing it. This is imperialistic unjust and should be an illegal form of warfare.

    Doesn't the National Guard have legal authority to use lethal force within the united states? What is different from an Air National Guard helecopter with a pilot and a National Guard Drone with no pilot?

    The Governer of each state can call up the National Guard in emergencies, why not use drones. What's the problem.

      The problem is that a helicopter pilot is a human being sent out on a mission, and can reason and empathize like a human being. A drone jockey sitting in an underground bunker hundreds of miles away operating a joystick on a television screen is just as capable of killing, but in a very dehumanized way. It removes whatever slight moral dilemma is involved in killing a fellow human being.

        You misjudge the effects on drone pilots. Recent reports indicate that these drone pilots do suffer from PTSD. Another point is that a jet flying at the speed of sound, and under orders to, say protect, the airspace of secure sites, what real judgment does or should a pilot have.

    This country has changed a lot! There is a reason that Fidel Castro was never assassinated, nor were a number of terrorists, including Saddam Hussein (pre-war), etc. It has always been against American principal to resort to "murder" – justified or not – to achieve our political goals and protect our country.

    You don't have to be very old to see how a similar problem – civil liberties – have been shelved in lieu of "protection against terrorism." We have so many less freedoms now than a dozen years ago that it is mind-boggling. If things keep on that course what kind of America will people be living in by the middle of the century?

    We have to live by our own example. That means not to violate liberties in the name of liberties. This is not political – but rather a simple definition of what America is all about.

        If you take-up arms individually to fight one-on-one with the US govt, you would right-fully be called a lunatic. There is legal recourse for most individual grievances.       Can you really not envision a logical and reasonable use of force by a drone on US soil?

      Would you be ok with striking a convoy of a few cars that is proven to have a large explosive device and the intent to use it if they are heading towards a large city? If there is no other means to stop it, I would say that it would be logical to take it out with a drone.

    I seriously don't see why people (Republicans) are throwing a fit over this. All drones are are unmanned aircraft which are basically small attack aircraft. Would they rather us send in our A-10s or AC-130s? I highly doubt it. This is the 21st century people. If you can't break through a wall, go over it.

    Hopefully the Supreme Court sees this as a clear violation of the Posse Comitatus Act. In simple terms unless the person who operates the remote control plane is a member of federal, state, or local law enforcement, it would take an act of congress to authorize a member of the military to attack American citizens.

    If anyone would care to read the Holder letter, Holder is actually questioning whether any President has such an authority, and says simply that it is possible. His examples of where it might be deemed possible is attacks similar to Pearl Harbor, and the Twin Tours attack of 9/11.

    I would also like to point out that the military currently has the authority (and I'm not sure if the President even needs to authorize it), to shoot down planes entering into secure airspaces within the US. At this time, the Air Force scrambles jets to intercept and try to visually contact the plane and pilot and direct or force the plane down. They are also authorized to shoot it down. If this is allowed to be done by the military without the okay of the President (that is there is a standing order, and I suppose Congress has been involved in okaying this - it isn't a secret, obviously), then I would assume a drone could be used for the same purpose. Holder didn't mention this, but it would seem the obvious extension to using drones is not out of the question.

    Remember, local police forces are requesting drones for their use. So, don't just think it's the Feds. It's state and local police forces also. Also, government organizations such as Interior and state DNR's want to use drones for monitoring fire conditions and environmental conditions. Add to that, state transportation depts want to use drones also for traffic monitoring. Add drones for monitoring storms, tornados, hurricanes, etc.

    So yes one possible use of such force is if some rebel group raided an Army and attacked the government. How large the Attack must be before the DoD and not the local police used I don't know. But the obvious example is the US Civi War.

Pistols are responsible for the vast majority of murders in Chicago each year and the Biden Approved Shotgun could take out a room full of school children much more effectively than an assault rifle.         Why bother shooting? They =still= haven't fixed the encryption control issues. Jam the puppy and watch the remote controlled plane faw down go boom. Hellfire is a laser follower. Know how easy those are to spoof? Unless they use a modulated pulse, any designator you can get at a gun show will confuse the seeker. Refractive plastic on the target will do the same; bounce the laser off at an angle. If you need to go really low tech, just start a very smoky fire. The designator won't accurately penetrate smoke. Or fog. Move to a moist valley and let Mother Nature obscure you at nights and part of the year. Drones are nifty tools that can easily be misused.....but they are just machines. And like any machine, they have vulnerabilities; some rather simple to exploit.

      Are you nuts? Use an AR15 on an aircraft? the problems with that is (1) the bulets do not go that far, the riffle lacks the requited range and (2) it is not early accuracy enough. The "kick" for the first round causes the second round to be un-aimed.

      To shoot one down you'd need either an antiwar missile or a radar guided AA gun.

    This isn't kill order on anyone. He's saying it's possible. Meaning a domestic terrorist if other options weren't viable. If that terrorist was in an urban area it would be impossible- but if holed up in in the wilderness quite feasible to locate and take him out quite effectively.

    Drones won't be used in the U.S. for the simple fact that drone missiles are very expensive. The FBI isn't going to want to spend $500k or more worth of missles at a rusted pickup truck in the U.S. When the Pentagon does the same thing in a foreign warzone it's considered normal. Can domestic policing department budgets handle it? I don't think so. Besides, collateral damage? If you accidentally blow up a school bus full of kids in Afghanistan, that's one thing. Doing it in the U.S. carries way harsher political consequences.

      Funny how all the right-wing pundits said Bush and Cheney were "keeping us safe" when they authorized the use of military force to shoot down civilian aircraft (and left it as a standing order) that were even SUSPECTED of being hijacked after 9/11. Look at all the milita nutjobs that have been preparing for the end of the world (government, nuclear strike, zombies- all equally likely as far as most members of the Tea Party are concerned) and have set up compounds. A drone strike when one of them goes too far makes a lot more sense than letting them kill members of law enforcement before they all drink Kool-Aid and hitch a ride on a passing comet.

At least on 9/11 the reaction (that never happened) was an interception on a known threat in the middle of an actual attack. The police don't have F-15's.
