Court says Hasan can be shaved

A military appeals court decided Thursday that accused Fort Hood shooter Maj. Nidal Hasan can be forcibly shaved, despite his assertion that his religion requires he wear a beard.

Siding with the judge overseeing the trial, Col. Gregory Gross, the U.S. Army Court of Criminal Appeals ruled that the Religious Freedom Restoration Act does not allow Hasan to wear a beard during his upcoming court martial, as Hasan did not prove his beard was an expression of a sincerely held religious belief.

"We agree with the military judge's conclusion that petitioner's wearing of the beard denigrates the dignity, order, and decorum of the court-martial and is disruptive under the current posture of the case," the decision says.

Even if Hasan did wear the beard out of a sincere religious belief, the decision found that "compelling" government interests justified the judge's order for Hasan to be shaved.

The military psychiatrist is accused of opening fire in November 2009 at the Texas Army post's processing center, where soldiers were preparing to deploy to Afghanistan and Iraq.

The attack left 13 dead and 32 people wounded. Hasan was paralyzed from the waist down after police exchanged fire with him.

His court-martial had been scheduled to start in August. But the appeals court delayed its start to determine whether his beard can be forcibly shaved during trial.

Army regulations prevent soldiers from wearing facial hair while in uniform. Hasan, who is still a soldier, is a practicing Muslim and maintains he has the right to wear the beard under U.S. laws protecting religious freedoms.

At a hearing in August, Hasan spoke about the beard he had grown.

"Your honor, in the name of almighty Allah, I am a Muslim," he told Gross. "I believe that my religion requires me to wear a beard."

Prosecutors argued that Hasan should have to shave his beard, saying the facial hair would make it harder for witnesses to identify him in court.

Gross ordered that Hasan would have to shave, triggering the appeal from Hasan's lawyers that was decided Thursday.

The court's decision can be further appealed to the U.S. Court of Appeals for the Armed Forces, an independent tribunal with worldwide jurisdiction over active-duty members of the U.S. armed forces and others subject to the Uniform Code of Military Justice.

Members of Hasan's defense team have indicated they plan on appealing the decision, according to Fort Hood.

If convicted of the shooting, Hasan can be sentenced to death.

A U.S.-born citizen of Palestinian descent, the licensed psychiatrist joined the Army in 1997. Though he was scheduled to deploy to Afghanistan, he had been telling his family since 2001 that he wanted to get out of the military.

Hasan told his family he was taunted after the terrorist attacks of September 11, 2001. Investigations tied to the Fort Hood shootings found he had been communicating via e-mail with Anwar al-Awlaki, a radical Yemeni-American cleric killed last year in a U.S. drone attack.

    I don't even understand the issues that surround this case.

    In the past, he would have been put up against a wall and shot as traitor immediately with as many eye witnesses as there were and the fact that he confessed to the killings. This is messed up that we are even having a trial.

      No, Patrick, it is NOT an attempt to please anyone. The regulations for acts of murder by armed forces personnel have always required a court martial. You need to get your head out of your butt; it's so dark in there you can't see anything.

      "In the past" the commanding general at Fort Hood would have convened a general court martial within a few weeks, as soon as Hasan and a sufficient number of those he had wounded were medically able to be present in the court.

      Hasan would have been speedily convicted, based on the physical evidence and the eyewitness testimony of the survivors.

      Hasan would have been sentenced to reduction in rank, forfeiture of all pay and benefits, a dishonorable discharge from the US Army, and a sentence of death by musketry or hanging.

      His sentence would have been appealed and quickly affirmed.

      Hasan would have been wheeled from his cell in a stripped uniform, and taken to the place of execution accompanied by the post band playing "The Dead March." There he would have been put to death. For practical reasons, probably by musketry - a firing squad of 8 or so Military Police armed with rifles, followed by an MP sergeant putting a pistol bullet through his brain to be sure he was dead - and then his body would have been dumped in a coffin, shoved in the back of a truck for a trip to a numbered but nameless marker in the post cemetery. And the firing detail, witnesses and post band would have marched back to garrison, the band "playing a lively tune" as per DA Pam 27-4.

      They went to court to ensure that the prisoner Hasan will comply with a lawful order to meet the grooming standards of the Army regulations that he is legally required to obey.

      It should not have been necessary. The Supreme Court ruled years ago that there is no "right" to disobey military uniform regulations for religious reasons.

        Hasan is still a soldier, and he will comply with the lawful orders of his superior officers.

        Hasan is trying to turn a US Army court martial into a combination al Qaeda propaganda act and sharia law hearing.

        It will be neither. Hasan is subject to the UCMJ. His beard is in violation of the US Army's uniform regulations. He will be shaved and wheeled into court to face the justice he deserves, as a soldier.

        And once he has been convicted, we will strip him of his rank, strip him of his pay, and put the son of a b1tch to death as a traitor and murderer.

    Why are people posting such hatefull comments towards Muslims. The actions of one does not say for how others feel. Yes there are radical Muslims but there are radical Christians as well. The Ku Klux Klan is a Christian organization who kill people in the name of Christ.We don't go running around saying things like "I hope they make hiim sit next to a bunch of burning Bibles and is touched by a priest" and other stupid things I am not a Muslim, in fact I don't associate with any religion, but I have many Muslim friends and I'm prety sure none of them are going to kill me for being an 'infidel' or blow up some towers. Because he did something horrible does not mean he should be treated badly. Besies if he is found guilty, which he will almost 100% will be, will be sentenced to death.

      Stop trying to play the nonsensical guilt game over the Crusades and the Spanish Inquisition: those have been over for centuries. And, it's worth pointing out to the historically ignorant - both were in response to Muslim aggression.

    He is still in the military and this should not of been a question of keeping the beard. All soldiers are supposed to be shaved at all times because we are on duty 24 hrs a day 7 days a week 365 days a year. No one raised his hand when he swore in to be a SOLDIER in the United States Army. I do not know why his attorney's think they can appeal this decision. They are delaying his trial because they know his already guilty.

      You have never been in the military. I was in there, served 20 years, and retired. I'm going to clarify the beard thing. You can be authorized to wear a beard for religous and health reasons. You can only be told not to wear it if it interferes with your duties (i.e. remove a wedding band when working mechanical stuff where you could lose your finger, no wearing a cross if it could be cause in machinary, etc.).

      Even if he didn't have a beard when he was in the Military, he has officially disclosed he believes his religion requires him to wear a beard. Is there a reason why the beard would interfere with duties in the court room? I believe the removal is more of an example of judge's abuse of power because of his own intollerance against the accused. I believe the judge feels this is his way to get a little revenge for him killing fellow soldiers. There is no reason he shouldn't be allowed. There are plenty of people that have them in the Army doing a desk job.

      I would like the court to prosecute him quickly. I personally think he suffers from PTSD and cracked under the pressure. I think the man needs mental health assistance. The Army has done little to help those with PTSD during that time frame, and owes it to everyone suffering from it. The Army was putting people out with mental disorders so they don't have to pay for medical disabilities. There are many court cases showing this. Get the man some mental help, and honor his fellow soldier's memories. I believe his fellow soldier's would want to take care of their buddy. I know I would.

        You're spewing bs. I served in Afghanistan and there was a no beard rule in full force. Only special ops can grow a beard to blend in with the population where they are stationed. Also, Hasan had no facial hair during the entire time he served in the military so why let him have it now just because he killed fellow soldiers.

        1. You are wrong about beards. The US military has not allowed beards for many years except for medical reasons – usually for ingrown folicle reasons.

        Sir, you are mistaken in what you say. The Army policy currently precludes beards, although there is still discussion about Sikhs, whose religion specifically requires beards. The standard, and the standard to which Hassan adhered before his 'conversion' requires all soldiers to be clean shaven. Since he is still a serving member of the U.S. Army (he has not been convicted yet), he is required to follow all regulations, including being clean-shaven. The judge isn't being vengenful. Quite the contrary, he is being extremely careful not to violate any of the regulations that apply to this case, including Hassan's right to appeal the shaving order, so that he will have no basis for an appeal of his conviction. The PTSD argument is fatuous: he and his attorneys are trying to create as many road blocks and delays as possible and are intending to make the trial about religious freedom, oppression, etc., rather than murder.

      Actually, the Army has a very specifically defined procedure for forcibly shaving a person, including the presence of medical personnel and the use of electric clippers rather than a blade.

    black jack persing had problems with muslims during one of his tours. from what i have read,he captured some and shot[how many i am not sure],and placed either pig blood or pig bodies in the graves with them. there was no real trouble for almost 50 years after this....good idea, but the aclu and other bleeding hearts would scream bloody pun intended...but a good idea in any event.

    1-simple not complicated–2-hasan enlisted in 2001–this ocurred in2009-all reports indicate he indicated-then-to his family- he did not want to be in–unless he enlisted for life–he reenlisteed again–3–did he grieve not wearing a beard from 2001 on?–unless-of course-he became muslim later–beard not an issue–both of above are simple–individual is full of excrement–also-why the stall us govt?–afraid all the intelligence known by intelligence community–that was clearly not acted upon-may come to light?–love the country-fact is-its leaders also possess some of the major's traits-2 problems-fix both–either way–hasan–afraid of signing the death warrant mr president?–wouldn't look good to the muslim community??–hahaha-shave city time.

    Any decision seems like a "no brainer". He VOLUNTEERED to join the Army, under his own free will, NO DURRESS, signing a contract to follow their rules, including being CLEAN SHAVEN. Whether he was Muslim or converted after is moot. His only defence would be to prove that that contract is void!

      Actually Uniform Code of Military Justice allows a waiver for wearing a beard if it is a part of the religion or by shaving it causes the individual health issues. I find it funny how it was alright for him to have a beard when serving as a Soldier, but some how the beard affects the prestige of the court. How does his beard affect how the court works?

      I think it is more of a sign of the religious intollerance secretly applied in the Military against Muslims. Although I am Roman Catholic, I find it disgusting and indignified that they would shave his beard. I know too many Muslims who find their beard as sacred as a Catholic finds the Cross sacred.

        Actually, they are making him shave his beard because he did not have it when he allegedly committed the crime. He only started with the beard after the shooting. As stated by the prosecutor, " facial hair would make it harder for witnesses to identify him in court." If he had the beard at that time, it would make it harder to recognize him without the beard.

        The only time a member of the armed forces is allowed to have a beard is when there is a medical reason to not shave, i.e. it causes substantial irritation or infection. And you cannot "tailor" the beard to a certain style. Religious preference never supersedes "good order and discipline".

        What is not "funny" is how this traitor was clean shaven during the attack.

        What is not "funny" is how when this waste of humanity is finally coming to trial for his crimes he tries to wrap himself in the cloak of the Koran, and the freedoms that this country gives him – at the same time.

    For years we heard that military trials were faster and more efficient than civiclian trials. This guy shot up Fort Hood almost 3 years ago in front of dozens of witnesses and he still isn't on trial. We're ruling on whether he gets to keep his beard. So much for military efficiency.

        Absolutely nothing convoluted about it. He voluntarily joined the military in the first place; despite the taunting he said he received after 2001, he voluntarily made the decision to renew his commission (as our millitary do not enlist for life – at most he joined for 4-8 years at a stretch). He is a member of our US military until such time as the two parties to the contract (because that is what you sign) decide to dissolve the contract. As such, he is considered a member of our military and is/will be subject to the terms of the contract he signed with them.
        You don't have to like it, but you do have to abide by it.

        Nidal Hasan should be tried for HIS actions Although as a still active duty soldier he is subject to abide by the UCMJ. Prior to the shooting he could have filed for Conscientious Objector status and been discharged. As an Officer he could also have resigned his commission. Unlike enlisted personnel, officers do get preferential treatment.
        Since 2001 as a civilian it would be easier for the US gov't to charge and hold him as a terrorist for what he is.
        If and when he is convicted he should not automatically be discharged but held in a military prison to COMPLETE his sentence, upon which he should be dishonorably discharged.

      As for his beard, or you kidding me, this gentleman (and I use that term lightly since he is still an offier in the Army) is still an active duty officer in the U.S. Military and therefore goverened by the UCMJ and grooming standards set forth by that branch of the military. Beards have not been allowed for a long time. He signed the paper of his own free will and without any mental reservations, i.e. he chose this and therefore he is to abid by the rules and regulation of military service. I wonder what General George Patton would have done with him...

        No, the UCMJ does not give him a blanket exemption to wear a beard if he pleases, on "health or religious" grounds.

        Hasan does not have a shaving profile. And even if he did, he would not be allowed to wear a bushy jihadist beard. Army standards are quite specific about shaving profiles. They must be (1) medically approved and (2) even with a permanent shaving profile, per Army Regulation 40-501 "Soldier is to shave every 3 days with clippers. Facial hair is to be trimmed regularly not to exceed 1/8th inch as to maintain a neat and clean appearance.’

        Nor does Hasan have a religious exemption. A waiver of AR 670-1 grooming standards is not something that the Army is required to provide. That is settled law, upheld by the US Supreme Court. The Army can issue a waiver, if one is requested, and if the Army believes that one is necessary in order to obtain the services of a person with a unique qualification.

        Such waivers are exceedingly rare, and are only issued prior to entry onto active duty.

        Hasan did not request such a waiver, at any time.

        Hasan is legally obligated to obey lawful orders. Such lawful orders include compliance with the grooming standards of AR 670-1. Hasan has refused, and now Hasan will be involuntarily shaved just as other prisoners have been when they refused lawful orders to comply with AR 670-1 grooming standards.

        Since the Army sent him through USUHS, it means that he has a specific obligation which only DA can waive – he can always request a release from active duty, but DA gets to make the call based on their needs and the situation. The fact that he received a poor OER prior to his PCS to Ft Hood coupled with issues during his residency at Walter Reed could have likely provided the Army with enough reason to boot him out (i.e., for good of the service). Problem is that the PC climate in the military today is disgraceful at best and with Hasan's actions, criminal at worst!

      That's not exactly true. The army put him through medical school (in fact he attended the military's own medical school). When he graduated in 2001, he would have had a 7 year service committment. However, he then would have to gone to residency (to be come a psychiatrist). This would have been another 4 or 5 years that doesn't count towards his payback. His service committment would have ran through 2012 or 2013 most likely. He still should have known all of this in 1997 when he signed up.

    There is no rule in Islam that a Muslim man must wear a beard. Sporting a beard does not make one a better Muslim. He must follow the rules and regulations that he swore to uphold when he became a member of the US Military and therefore if he is a good Muslim he must abide and respect these regulations. The Military has every right to force him to appear clean shaven to faces his charge or to charge him if he disobeys these regulations. As a Muslim, I would advise him to shave and go to court and face his charges like a man and to remember that he will be also judged by Allah SWT in the hereafter.

    he has to be sane enough to comply and understand he is still in military when they make him put a us military uniform on for the trail anyway ... so he also has to shave to be in uniform ... unless the appeals court will be used to decide this rule once and for all (as obviously they plan on doing). it would be nice to see more focus put on deciding when and if these people who want out because they know they are sick – get the help they need – when they need it – so they don't go insane and kill people like he did. there are many issues on mental health – and true help and respect for soldiers opinions on their own wellbeing and what is best for them (and therefore others perhaps) so they can get out or get the help that they need to stay in.
    mental health system in military is a reflection of mental health in public and private sectors
    pills for ills ... and mass killings
    no real help – only prison and beatings

AR 670-1, part 1, Chapter 1, section 1-8, section 2, paragraph (C). So unless he went out and got himself a "Shaving Profile" (a medical permit signed by a doctor, that goes against shaving, due to razor bumps and/or skin irritation), he is REQUIRED to get rid of his facial hair. Point Blank. Besides..... He was a "Muslim" in the Army many YEARS BEFORE the shooting.. .... And he was SHAVING everyday before work. So he can save his sob story for some one who gives a dang.       This man in joining the military waived some of his personal rights. When he joined he was required to shave and to remain clean shaven for the duration of his contract. He is still a member of the military and until he is either released or executed these rules will remain in effect! His growth of a beard is merely a childish form of protest.         The biggest misnommer out there about the beard. The Army authorizes wear of a beard in uniform for religous and health reasons, although it must be neat. Just try him quickly and forget the beard. The beard cannot affect how the court works. I think it's the judge's personal prejudice against the accused (and all Muslims) that preempted this. Even though I feel he should die, the Military should not sink to his level when inacting justice and be fair.

He did not have an issue following military rules regarding shaving requirements before he was arrested so yes, he should continue to be held to these standards during his trial. Once he is convicted or discharged or whatever happens and he no longer has to be in uniform he can grow his beard all he wants.
      As for the head scarf comment, if an individual joined the US Military they are not allowed to where a head scarf while in uniform so the same thing applies to the head scarf as the beard. Now if this were a civilian court and she were not in military uniform then yes, she would be allowed to where her scarf.
      If this guy was in a civilian court and not in uniform they would not care about the beard, but they are requiring him to follow military standards. Those do not go away just because you are on trial.

      In Islam, ladies must wear a Hijab to cover their hair and may only reveal her face. The rest of her body should also be covered and not revealing. This is the rule of modesty and is clearly stated in the Koran. It is for her own protection. Sporting a beard is not a mandatory rule in Islam. Millions of muslim men who sport beards are only trying to emulate Prophet Mohamad, May Allah's blessings be upon him. They have been taught this through their upbringing and religious culture that sporting a beard or a goatee will make them feel and identify themselves as being better Muslims if they follow the ways of Allah's messenger. In many Islamic sects having a beard or goatee is like group ID that will identify them as Muslim. But Allah SWT has also clearly told all Muslims that they must respect and serve all humans no matter what religion, race or color. He is in the United States Military and as such, he is NOT allowed to permitted facial hair. It is really too bad that he has more rights as a killer than his victim's and their families.       ACTUALLY there are members of the US Armed Forces that are permitted full beards due to their religions, I've met a captain in the Army whom was a Sikh and was permitted to keep a full beard and wear his turban while in uniform. Know before you speak.

        No he is not. I'm a retired Military Vetern of 20 years. You are authorized to wear a beard when it is part of your religion (as it is for Muslims) or for health reasons. I probably can quote the actual Army Regulation (AR) that governs it if I spend the time trying to find it.

        I want to see him die, but I don't believe we should sink to his level and degrade him because he acted as he did. He clearly was mentally unstable and had been, probably suffered from PTSD, and the Army was aware of his condition. The Army should have put him out with a medical discharge. But that his hind sight.

        It's AR 670-1, para 1-8, by the way.

        And there is no exception for religious reasons.

        There are two ways to legally have a beard in the US Army: (1) a shaving profile, temporary or permanent. Hasan has neither, and has never applied for a shaving profile. Even if he had a shaving profile, he would be required to keep his "beard" no longer than 1/8 of an inch. (2) Have a waiver, agreed to prior to entry on active duty. The Army has agreed to such waivers for a handful of soldiers with special skills. There is a Sikh medical officer, for example, and an Orthodox Jewish chaplain, who have received waivers. Waivers that they asked for before entering the Army, and that the Army agreed to in order to obtain their unique services. Hasan never applied for such a waiver, and he would not have received one. He is an ordinary psychiatrist, with no unusual or special skills deserving any accommodation on the Army's part.

        And spare us the PTSD nonsense while you're at it. Hasan was never deployed. The only "combat" he ever saw was being shot while in the act of mass-murder.

      Incorrect. The US military has overridden Hasan based on the fact that they do not believe his religious beliefs to require, or be as solid as he claims. The Obama Administration has specifically classified the Osama bin Laden death photos because of concern that if released, they would only serve to help martyr bin Laden, and could be inflammatory to the wider Muslim population.
      The concern is that protests conducted against the release of the photos could be used by extremists infiltrates to stage violent attacks on US or Allied targets across the world, further risking American and Allied lives, while producing no benefit to any foreign policy or military campaign.

      Actually the court ruling basically was about whether or not he can be forcibly held to military codes governing his appearance at a formal proceeding. Since uniform regulations specifically prohibit beards, and limit mustaches to within very strict confines, and he is under military arrest, he can be held to maintain those personal appearance regulations.

Perhaps if you looked at artists' versions outside western civilization where other cultures have been fooled into following what is deemed to be Christianity you would get a more clear perspective on how silly your question really is. In India there is one painting of your Jesus in a pose akin to one of their more common demigods (Krishna), complete with blue skin, large eyes, and no beard.         Jesus was a Jew. Jews of the time commonly wore beards. Orthodox icons of Jesus all show him wearing a beard, and always have done so since the early centuries after Christ. Such icons are based ultimately on verbal tradition. Wearing beards was the custom in the time and place where Jesus lived.

      The US military has had specific rules about personal appearance for many many many years, he agreed to abide by the standards the US military set when he accepted his commission as an officer, just because he has violated the UCMJ and is a prisoner, does not mean that he is not still expected to conform to military regulations.
      The US military isn't waging a war against facial hair, but it does have specific requirements that all recruits are taught. Now it's being enforced.
