Army general faces possible court-martial on sexual conduct, other charges

The former deputy commander of the Army's 82nd Airborne Division has been charged with numerous violations of military law, including forcible sodomy, the Army said Wednesday.

Brig. Gen. Jeffrey Sinclair has been charged with "forcible sodomy, wrongful sexual conduct, attempted violation of an order, violations of regulations by wrongfully engaging in inappropriate relationships, misusing a government travel charge card" and several other counts, said Col. Kevin Arata, a spokesman for the Fort Bragg-based 82nd Airborne Division, which since its creation during World War I has been one of the most celebrated units in the Army.

Specifics of the alleged crimes were not released. It could not immediately be determined whether Sinclair has an attorney.

Army spokesman George Wright said Sinclair currently is still on active duty, serving as a special assistant to the commander of the 18th Airborne Corps, and is not restricted to base. As is standard procedure in military criminal matters, he continues to be paid his salary.

Sinclair, who was sent home to FortBragg in North Carolina from Afghanistan earlier this year, will next face the military equivalent of a preliminary hearing, a so-called Article 32.

That's a hearing in which both the prosecutor in the case and the defendant's lawyer can present witnesses and evidence. At the end of the session the "investigating officer," who acts as a judge in the hearing, will make a recommendation as to whether a defendant should face court martial. That recommendation goes to the "appointing authority," an officer higher up the chain of command from the defendant.

No date has been set yet for the Article 32 hearing.

      Exactly. I don't know the details, but a suggestion by a superior officer is considered a direct order in the military. This could be as simple as telling a lower ranking woman to give him head, and then afterwards she reports him.

      he was having an affair or affairs with subordinate women at least one of whom gave him oral. the sodomy charge is because of the oral and the 'forced' because she(they) is a subordinate. its the military equivalent of a guy getting it on with his secretary in the civilian world. but under the UCMJ he can go to the brig.

Seems every week I read about another officer in some sort of misconduct, either in the Army Times or a major news network. These people need stern discipline and obviously training is missing somewhere... These are the men who lead many others in peacetime and combat situations and need supervision themselves. Unreal, just really dissappointing. They say military personnel are held in high regard by the people of this great country and this repeated behavior does nothing but really dimminish the great things that many others have done!

      Media shouldn't report any arrests, only convictions. Many people are charged, only to have charges dismissed or be found not guilty. But by the time that happens, the person has been already treated as a convicted criminal by the media or the community. European media only report the first name and last name initial, a much better way.

Doesn't the armed forces consist mostly of poor dead-end losers with misplaced obsessions and ideals who have no other choice but to become killing machines for wealthy war mongers who couldn't care less about them or America?

        YBP – I couldn't have said it better. Today's "all volunteer" military is really nothing more than a bunch of uneducated mercenaries. There's a reason that military recruitment offices are now called Armed Forces Career Centers. Perhaps Mitt Romney would use his experience at Bain Capital and outsource our military to some low wage third world mercenaries, who wouldn't receive any military benefits.

        President Bush had the CIA on the ground in Afghanistan in a matter of days, with the US military following shortly after. The Taliban was effectively neutralized as a governing force within 30 days. I'd say that his response to the 9/11 tragedy was effective and a good display of leadership. Clinton would have lobbed two dozen Tomahawk's and called it a day.

    What do you know that the media isn't privy to, or isn't revealing? It would seem little or no information about the alleged incident is being revealed – only the basic charges the general is facing. Please share, if you would, what makes you so certain the man is innocent.

    I am wondering how this situation got this far. When women in the military are assulted or raped by a fellow soldier; virtually nothing is done about the charges or anyone punished. I guess going after the "boys" is not acceptable, but going after the girls is "OK" in the boys club.

        I have witnesed it in two of the units I have been in. Rules, as it would seem, are in fact made to be broken. There are very few of us that have not broken them. We are indeed the minority.
