Board recommends dismissal of anti-Obama Marine

A Marine Corps board has recommended that a politically active Marine sergeant who questioned President Barack Obama's authority be dismissed from service with an "other than honorable" discharge.

Sgt. Gary Stein, who posted anti-Obama comments on his Facebook page, stands accused of violating a catch-all military justice provision against conduct endangering "good order and discipline."

He is also accused of violating a Department of Defense policy limiting the political activities of service members.

The recommendation for dismissal, made late Thursday, will now go to a separation authority headed by Brig, Gen. Daniel Yoo, commander of the Marine Corps Recruit Depot in San Diego, said Maj. Michael Armistead, the public affairs director for the installation.

It could take two to three weeks for the authority to hand down a decision, Armistead said.

If he leaves the Marines with an other than honorable discharge, Stein will be demoted a rank to lance corporal, Armistead said.

Stein came under scrutiny from Marine officials after saying he would not obey Obama's orders.

In a January 26 post to the Armed Forces Tea Party Facebook page, Stein called Obama a liar. Two days later, he said the president is "the 'Domestic Enemy' our oath speaks about."

In a March 4 posting, he questioned Obama's birth certificate. Another discussion on the site in March said he would refuse to obey orders given by Obama. He later clarified to say he meant illegal orders, which he has explained as orders such as sending the military to Syria without congressional approval.

"The allegations drummed up against me are no more than an agenda by the Marine Corps to use me as an example," Stein said in a statement posted to his page.

"If I am guilty of anything it would be that I am American, a freedom loving Conservative, hell bent on defending the constitution and preserving Americas greatness."

He noted that the opinions he expressed were his own, saying, "I have never spoken on behalf of the Marine Corps or in uniform."

He told CNN the charges were a "PR thing."

"They have to make some sort of stand with this," he said.

His Facebook page Friday said simply: "On to the next fight."

    The service members are like the actors and actresses showing up at the military play. This marine seemed to ruin the whole play by saying the lines which were not available in the U.S. military play. Then he was asked to drop out of his military stage. It was that easy, I think. Well, good for him.

    The thing i don't understand is how the Tea Party and the right wing Republicans can actually try and sit there and tell the citizens of the United States that they are defending the Constitution and are protecting people's rights and all this but then they go and try to push through bills that try to tell the American people how to live their lives. They've tried to push through bills that limit birth control etc. how can they not realize that what they are doing is the EXACT opposite of what they claim to be fighting for? They're saying, we're here to fight for your rights... but then trying to force people to live exactly how they want them to.... They are straying so far, they're becoming Anti-American, Anti-Democracy. Especially with all the hissy-fits they throw when they don't get their way, they try to block EVERY piece of legislation that gets brought up for vote... Democracy is about compromising with the people you don't agree with, in the understanding that Neither Party represents ALL Americans... I'm not a Dem or a Republican, I've always stayed in the center but the Right has strayed so far it's hard to find a worthy Republican Candidate anymore, they've allowed their party to get highjacked by the right wing and that's ridiculous... they're getting more extreme by the day.

    The Marines are right to boot this yahoo. Regardless of your political views when you're in the military you swear an oath to follow the orders of the President of the United States and the officers appointed over you. It's an OATH. If you swear that oath then say you're not going to follow his orders, you should be kicked out... Think every soldier was happy with George Bush's policies? Nope, but you follow his orders as a soldier, you're not political. You can choose not to obey an order if it violates the constitution of the United States but you can't just jump on board with some political activist group that made up some phony crap about the President not being a citizen so you can use lies to justify disobedience. I think he's lucky if all he gets is demoted and booted... he should be in jail for treason. Treason in war time is punishable by death, so if anybody thinks he's getting off light, you're wrong.

However a member of the armed forces does not have the option to obey or disobey orders on an arbitrary basis.       Exactly, that's the ticket right there... Soldiers can't choose to obey orders from one President then go and disobey otherse because they don't fall into his political point of view... It's not a game... it's not a political game... This is why i think groups like the Tea Party are the worst thing in the world for the U.S. ... Creating and backing severe ideologies to try and call freely elected politicians illegitimate simply because they do not follow their doctrine, that is in my opinion treason. Unfortunately there's nothing against it... though technically the President could sue the Tea Party for slander it's not something a politician would do... it wouldn't help his Presidency either. Isn't it funny though that This "tea party" and it's following are actually breaking the law with their Birther movement and nobody points that out... It's illegal to lie about someone in order to discredit them. It is called Slander and technically they could be held accountable.

        Be careful. There is a difference between the enlisted and officer's oath. While enlisted people are sworn to obey the orders of their officers, officers are sworn to uphold the laws of the US and defend the Constitution. As an officer you are expected to know what a legal and illegal order is, and if given an illegal order, run, not walk to the Judge Advocate General. This was done as a result of the post WWII war crimes trials. The US didn't want any US officer accused of war crimes claiming, as so many Nazi's did, they were simply following orders. As a US military officer, you are expected to know better.
        What this Marine did, however, was completely out of line. Two things are off limits in the ranks, religion and politics, and this is so to ensure unit cohesion. In combat, you have to be able to trust everyone in your unit, and be willing to sacrifice your life for your comrades. I don't think I need to explain at length how corrosive petty political or religious differences can be, or how they can affect one's trust of other unit members who's religion or politics might not match yours. This has no place in the ranks, so at least when I served, everyone's political leanings were a mystery. We never talked about it.
        You also do not bad mouth your chain of command. That too is corrosive if not punished immediately. If members feel free to disobey orders they disagree with or argue with their chain of command, discipline breaks down and you loose the ability to function effectively.

      You're spot on Just advice – As a Veteran of the US Army, I served in Iraq during George Bush's presidency. Believe me, not everyone agreed with his policies, but nobody and i mean nobody was willing to disobey an order from the President. It's not about politics in the Military, you're by definition, NOT POLITICAL... Rather you're the fighting body of the United States and you do what the head tells you to. People vote in Politicians, Presidents... It is not your job to disagree with the President, you're being paid by the taxpayers of the US to do what the President says, if you don't like the President, or don't like the idea that you may have to follow the orders of a President from a different political party than the one you subscribe to, DON'T JOIN IN THE FIRST PLACE. This guy is a disgrace to the Armed Forces, and being kicked out of the Marines is light sentence considering this guy is a traitor in war time.
