US defends right to pursue threats, no matter the country

The United States reserves the right to pursue terrorists unilaterally in other countries, White House counterterrorism adviser John Brennan said Friday night in a speech at Harvard Law School.
"The United States does not view our authority to use military force against al Qaeda as being restricted solely to 'hot' battlefields like Afghanistan. We reserve the right to take unilateral action if or when other governments are unwilling or unable to take the necessary actions themselves," Brennan told a conference on "Law, Security & Liberty After 9/11: Looking to the Future."
"That does not mean we can use military force whenever we want, wherever we want. International legal principles, including respect for a state's sovereignty and the laws of war, impose important constraints on our ability to act unilaterally - and on the way in which we can use force - in foreign territories."
The U.S. intelligence and military communities have used various means to go after terrorists, both in cooperation with countries and, in certain circumstances, unilaterally. The U.S. Joint Special Operations Command is increasingly active in Somalia and Yemen, U.S. officials tell CNN.U.S. officials have said they will target Yemen-American cleric Anwar al-Awlaki if they locate him. In May, the U.S.-born radical cleric based in Yemen survived an American drone assault after he switched vehicles. At the time, a U.S. defense official told CNN the strike was carried out by the American military.
Former CIA Director Leon Panetta discussed the U.S. approach to counterterrorism in the two countries during testimony in June at the hearing for his nomination to be secretary of defense. Panetta said then that the CIA needed to develop its strategy for dealing with threats that extend beyond Pakistan.
"Our approach has been to develop operations in each of these areas that will contain al Qaeda and go after them so that they have no place to escape," he said, citing Yemen and Somalia as examples.
Regarding al Qaeda in North Africa, U.S. officials were working with the Spanish and French "to develop approaches there that will contain them as well," he said.
The New York Times reported Friday that the administration's legal team is split over the lengths the United States can go in pursuit of alleged terrorists in Yemen and Somalia. The debate focuses on whether such pursuit should occur only in cases where high-level leaders have been directly linked to alleged plots to attack the United States or "whether it may also attack the thousands of low-level foot soldiers focused on parochial concerns: controlling the essentially ungoverned lands near the Gulf of Aden, which separates the countries."
Brennan said he was disappointed in the article, which he thought over-hyped the debate within the administration.
"It made it sound as though my goodness the administration is split on this issue. There's this great fight going on," Brennan said. "What we have now within the U.S. government at the insistence of the president and others is that type of discourse among the lawyers. That we want to make sure that we hear all the different views and perspectives. That provides us a good sense of what those legal parameters are within which we can work".
Regardless of the opinions voiced, Brennan said he has never been in a situation where legal interpretation prevented the U.S. from acting in the best interest of the country.
In the case of al Qaeda in the Arabian Peninsula, operating in Yemen and terrorist group Al-Shabaab operating in Somalia, Brennan said there is no question the U.S. has the right to go after the groups. Whether the threat comes from a low level suicide bomber or a high ranking member of the group makes no difference, he said.
"Sometimes those threats are because somebody's at the operational command, the equivalent of a bin Laden or somebody else who is orchestrating that, engineering it, preparing materials, thinking about the plans. There are the individuals, the operatives, the facilitators, who are carrying them out, the suicide bombers. So you have people in all different parts of the network, both in AQAP and as well as in Al-Shabbab," Brennan said.
"And consistent to what I was saying here, our interpretation of the law is that it allows us and we feel obligated to take actions to mitigate those threats that these terrorist groups and these individuals who are associated with al Qaeda pose to us".
The U.S. interpretation of what constitutes an "imminent" threat is now being recognized by our allies, Brennan said.
An important shift in opinion he said as "the effectiveness of our counterterrorism activities depends on the assistance and cooperation of our allies.
In a resolute fashion, Brennan also fortified other administration policies, saying the thoughts of some that the U.S. would rather kill than capture suspected terrorists is "absurd".
"I want to be very clear–whenever it is possible to capture a suspected terrorist, it is the unqualified preference of the administration to take custody of that individual so we can obtain information that is vital to the safety and security of the American people," Brennan said.

You're over-simplifying. Bush was not 100% wrong. Bush was right to go after terrorists on foreign soil with drones and Special Ops. And Obama, recognizing that was right, has stepped up such operations. But Bush was horribly wrong to have invaded Iraq and (to a lesser extent) Afghanistan. The former shouldn't have been invaded at all (a strengthened Iranian hand and the economic demise of the USA are that result); the latter should have been invaded to overthrow the Taliban and wreak havoc - and then we should have been out of there by now. bin Laden is dead; Al Queda is in disarray; mission accomplished. So, agreeing with and adopting a few of Bush's policies does not mean endorsement of all of them. Bush did irreparable harm to our country - economically and otherwise.

Iraq had active ties with over 300 terror organizations. There was a laundry list of reasons Iraq had to go. What justifies Libya? Humanitarian reasons? Ghaddafi was a piker – he wasn't a tenth of the dictator Saddam was on any given day. Any justification you make for a Libyan action, only applies ten-fold to Iraq; so go to it.

Why would we divide Pakistan? We simply need to remove the partition that the Brits put in place and allow India to reclaim Pakistan. The fact that we aren't directly allied to India already is ridiculous. India has suffered more than anyone from terrorist attacks originating in Pakistan. Our allegiance to Pakistan is the only thing keeping India from reclaiming Pakistan as a province. Don't you think a strong secular ally in the region would be better than the backhanded one sided arrangement we have right now? As for immigration, it's easier to keep them from emigrating in the first place. If they didn't feel the need to flee their country, they wouldn't be knocking on everyone else's door. The same could be said for Mexico. If we helped them establish a functioning economy, they wouldn't come here and burden ours. We'd also have the added benefit of a beneficial trade partner next door. I'm not one for unlimited foreign aid, but if can be shown to be beneficial to our interest, there's a place for it. It's better than spending billions on an occupation.
India can't really "reclaim" Pakistan... Pakistan fought a bloody civil war precisely to become a separate country based on Islam. They will never become a member of a modern, secular, free, society like the one that India is becoming... Islam simply is not compatible with that kind of arrangement.
Reclaim isn't really the appropriate term, since both nations were formed at the same time from the British partition of 1947. The point is that India has been constantly harassed since that partition, and have a right to defend against hostility from Pakistan (both state sponsored and independent). Pakistan would likely go into upheaval if India took them over, but I doubt that upheaval would be long lasting. The reason India is a secular government is because of the diversity of religious beliefs represented there. Pakistan would simply become a Muslim province that is no longer ruled by Islamic law. India has a much stronger military and police force, and plenty of room in jail for dissidents. The region needs a strong secular nation to take the lead, and it doesn't look like China is interested.

There are dozens of nations that have well trained special ops forces that could easily come into the States and kill or capture US citizens. Should we say the Russia, Israel, China, or any of the other nations that would be able, can cross our border and conduct military operations without our approval?

I can't believe some of the words I am reading. As a veteran, and more so as an American, it angers and saddens me to think that public opinion is so negative on the tactics employed by our government to attempt to keep citizens safe. It's a nasty world, full of hate. There are things that occur that are necessary to protect our freedoms and way of life that are not viewed as humanitarian. Sometimes diplomacy is useless. When your enemy's entire beliefe system revolves around holocausting a world of non-believers, and go to extreme lengths to accomplish murderous acts without concern of casualities, our country must act offensivily and eliminate such threats using the same lack of prejudice and without all this "red tape". You don't have to jump the fence and enter your neighbor's yard to kill the dog, all you have to do is simply covertly throw a poisoned steak over and you will get the same result. The US does this quite well, more so than you will ever read any in headlines. This is not some Christian crusade. This is the most powerful country in the world doing what is necessary to defend itself and other countries from the Islamic radicals. I assure you Mike, no country, to include France or Russia as you exampled, would have to chase terrorists into our borders and eliminate them thus blowing up building and cause casualities. We would never allow known terrorists to harbor themselves in our borders. France/Russia would communicate to us and we would eliminate them ourselves, and we do, often, you just don't see it on the news. I do not think there is a choice between living in a country run by middle east type governments or a US style democracy. I think its safe to say that no one really believed Bin Laden was capable of pulling off something like 9/11. In hindsight, its easier to realize where things went wrong. 9/11 was embarrassing, but it would be even more so if we jumped to the conclusion that just because Bin Laden's dead, that means terrorism will stop and won't prove to be a threat in the future.

Since the media and PC cultures does not wish to use 'Muslim' or 'Islam in front of the word 'terrorist', ‘radical’ ‘extremist’, etc, it is simply easier to lump all islamic terrorists and those that follow the absolute instructions of their terrorist muhammad into a term that means an international organization of loosely affiliated cells that carry out attacks and bombings in the attempt to disrupt the economies and influence of Western nations and advance ISLAMIC fundamentalism.
Make no mistake…according to the Koran, the “best” Muslims are those that fight for their allah while “bad” muslims who are considered “moderate”, “peaceful” and “not-muslim-enough” have no room in the muslim world because the Koran calls for their death as well!

I have known a few muslims and according to them Koran does not say anything like that. It is no different than Christians believe it is their job to convert the rest of the world and save them "Heathens".
Religion does not teach war. It is the bad leaders who bend its meaning to suit their evil purposes. The same has happened in Christianity: If not, why the Crusades, the spanish inquisition. Why are there so many demoninations of Christians? There was only one Jesus Christ.

The original intent should have been stated that we will find the terrorists, no matter which country they try to hide in. President Obama has orchestrated a superb, no-nonsense approach to the elimination of the terrorist element. If W. ('Shooter' Cheyney) had the same approach, instead of wasting trillions going to Iraq, who didn't have a terrorist network, we might have finished with the original terrorists criminal activities.

This doesn't surprise me. Why should it surprise anyone? Bush got criticized for being a "cowboy" in foreign affairs, but it's actually the way to get things done. You go where you have to go to do what you have to do. It's nothing but an extension of the policy that brought us to Afghanistan in the first place.
Hmmm, I don't know about this, im really conservative and also slightly hawkish when it comes to defending our country. However I believe in the sovereignty of a country, without they are not a country. I guess after bullishly rushing to join the Military after 9/11 and later realizing it really wasnt about that anymore ive revised my stance on the war on terror. Let us defend our boarders and interest and use diplomatic means to work with countries that will not authorize rendition on terrorist residing in their boarders.
I don't disagree. Imagine the US hawk's response when say France or Russia decide to chase one of their terrorist cells into the USA and use a drone to blow up a few buildings taking out several innocent US citizens. If their headlines read 'We defends right to pursue threats, no matter the country' I'm sure US hawks would think that was fine till 'that' country was ours.

What it boils down to is America saying "might makes right", that they have the right to conduct military missions on foreign soil whenever they feel like it.

Several of the individuals that provided logistical support for the 9/11 Al Quida attack on the World Trade Center are currently residing in Milpitas California.
They may include several former and current employees from the C.I.A., D.O.J., D.O.D, pre- Home Land Security agencies and non-governmental agencies.
Most Americans realize that not one person involved with helping the 9/11 attacks occur have ever been brought to justice.
Yet how is it that majority of the terrorists could not speak English, 12 of the 9/11 terrorists could live for 2 weeks just 2 miles from NSA head quarters in Maryland, take flight simulator lessons on Jumbo jet trainers, they needed lodging, several of them where on State department terror watch lists, etc...
It just makes sense that a logistic support network existed before and after the attacks. After the attacks they helped mislead the 9/11 investigation by capturing patsy's designed to take the fall.
