Ali Mussa Daqduq, a Lebanese militant accused of involvement in the murder of several U.S. soldiers in Iraq, was released by Iraqi authorities Friday morning, Daqduq's lawyer, Abdulalmehdi al-Mutairi, told CNN.
Daqduq has arrived in Lebanon, his lawyer said.
"Thank God, he arrived in Lebanon a few hours ago after he left Iraq this afternoon" al-Mutairi told CNN. "There is no legal reason for his detention. He should have been released months ago".
An Iraqi court cleared Daqduq in May, saying there wasn't enough evidence against him, an official with Iraq's judicial council told CNN.
The automatic appeal following that ruling affirmed the acquittal in June, according to al-Mutairi.
U.S. officials say Daqduq organized a kidnapping in the Iraqi city of Karbala in January 2007 that left five U.S. soldiers dead.
Officials said he was a 24-year veteran of Hezbollah who had commanded a special operations group sent to Iraq to develop "special groups" within Shiite militia. U.S. forces captured him in 2007.
Daqduq had been held in U.S. custody as an "enemy combatant" until the United States ended its military mission in December and handed him over to Iraqi authorities.
"This is an outrage," said Senator John McCain, R-Arizona. "The families of those who were killed by this terrorist should also be outraged and appropriate action should be taken as regards to our relations with the Iraqi government.
The State Department said it expressed its "deep dissatisfaction" with the Iraqi government's decision to release Daqduq.
"We continue to believe that Daqduq should be held accountable for his crimes. We've made this point very clearly to the government of Iraq," said State Department spokeswoman Victoria Nuland. "While we strongly object to his release, we've been informed by the Iraqis that they determined that they were no longer able to hold him under Iraqi law."
The State Department has made contact with the Lebanese government on this issue, according to Nuland, and will continue to pursue all "legal means" to bring Daqduq to justice.

My thinking, too. If there had been real evidence I would guess he would have been charged and gone through the court process by now. We are sure fast to condemn others for following the law, all the time using the same argument when one of our citizens is held without due process. The WSJ raised this issue when the US transferred custody of Daqduq over to Iraq last year and predicted that he would be freed. Where was CNN at the beginning? Where was CNN in criticizing the decision when it could have made a difference? Nowhere to be found. Now they are sounding the alarm. Too late CNN, as usual, on an issue that reflects badly on Obama's leadership.
But let's look on the bright side: Iraq is going reimburse us for the cost of the war with all that oil they have.......right? I remember Bush told us that so it must be true........right?
It's time for Americans to face facts. It's not the wars in Afghanistan and Iraq that lasted so many years. We fight wars to vanquish our enemies, and that happened in both countries in a few weeks to a few months. What's led to the ongoing military involvement and casualties is the "nation-building" that came after the war was over.
So, how's that nation building been working out, huh? Iraq is pretty much an ally of our worst enemy, Iran. Afghanistan will probably revert to Taliban control when we do finally leave.
When you stop to think about it, "nation building" is the purest hubris on our part. It simply isn't reasonable to think we have the wisdom and experience to successfully yank a tribal society still mired in medieval thinking kicking and screaming into the 21st Century. We still haven't figured out how to wake up a large segment of American society to the reality that African Americans are equal to white people.
You seem to forget what happens when we get involved in military actions in a country like Iraq or Afghanistan and then fail to assist with "nation building" as you call it. Remember the Soviet invasion of Afghanistan? We helped the Afghans beat the Soviets and then left. How did that work out for us? Well let's see, Afghanistan, due to the lack of our support after the war, was overrun by the Taliban, they harbored and trained terrorists who subsequently attacked and killed thousands of Americans on American soil.

If you want decomracy and self-governance to reign across the world then you have to respect the decision of the courts where such (in one form or another) those decomracies reign. No one here knows the evidence in the case so any outrage is unjustified. Right decision or wrong, it's nice to see that Iraq has a formal legal system in place and that they're holding their government together despite constant attempts from islamist radicals and tribal sects to disrupt the rule of law.

It is legal under U.S. law to seize people accused of crimes in order to bring them to a U.S. court for a fair trial . So if Iraq refused extradition and the United States knew where the accused was hiding- why was that step not taken? Why is it not being taken now? Courts in the United States provide people accused of criminal offenses with fair trials, and an acquittal in a U.S. court (or a conviction) would mean something to the families of the deceased victims of crime. Instead, the federal government valued extradition agreements with another nation over bringing someone accused of murdering our service personnel to justice. Why should full faith and credit be given to the criminal justice system of another nation which just recently in fact did virtually nothing to prevent the murders of thousands of its own Christian citizens?

The U.S. response reminds me of the scene in "A Few Good Men" in which the 2nd chair for the defense states her objection to a witness' testimony, only to be overruled by the judge, after which the attorney responds the she "strenuously objects." None of this theater is impactful where it matters, but, apparently, it plays well with the majority of the U.S. electorate...dolts.

Obama wanted the US to still have a contigency force in Iraq, but Iraq chose for the US to leave. I find it curious the article on USA Today quotes his lawyer about the fact the held him until after the election. Apparently, they did not want to embarrass President Obama during his re-election campaign. CNN's coverage fails to mention this fact.

300,000 Iraqi civilians were killed during the war. We killed countless Iraqis during our invasion. And dozens were killed by US personnel who are now in prison for murder. So do not pull the "we never killed any of them out of combat" bologna. It is well known that some were killed, some were raped, etc.. out of malice by criminals. In any big population you'll have a few murderers and rapists and this was no different.

If we had any real proof at all concerning the laundry list of things we're now saying he did, why wasn't he charged and brought to trial during those four years? It's never been considered moral or right in the western world to hold someone indefinitely based only on heresy and conjecture. Under the Geneva Convention, I think you will find it illegal to kill unless you are a combatant in the uniform of your country. If you are on the battlefield conducting warfare and are not a soldier in uniform , then you have no rights under the GC and can be terminated.
