Army general faces possible court-martial on sexual conduct, other charges

By Larry Shaughnessy

The former deputy commander of the Army's 82nd Airborne Division has been charged with numerous violations of military law, including forcible sodomy, the Army said Wednesday.

Brig. Gen. Jeffrey Sinclair has been charged with "forcible sodomy, wrongful sexual conduct, attempted violation of an order, violations of regulations by wrongfully engaging in inappropriate relationships, misusing a government travel charge card" and several other counts, said Col. Kevin Arata, a spokesman for the Fort Bragg-based 82nd Airborne Division, which since its creation during World War I has been one of the most celebrated units in the Army.

Specifics of the alleged crimes were not released. It could not immediately be determined whether Sinclair has an attorney.

Army spokesman George Wright said Sinclair currently is still on active duty, serving as a special assistant to the commander of the 18th Airborne Corps, and is not restricted to base. As is standard procedure in military criminal matters, he continues to be paid his salary.

Sinclair, who was sent home to FortBragg in North Carolina from Afghanistan earlier this year, will next face the military equivalent of a preliminary hearing, a so-called Article 32.

That's a hearing in which both the prosecutor in the case and the defendant's lawyer can present witnesses and evidence. At the end of the session the "investigating officer," who acts as a judge in the hearing, will make a recommendation as to whether a defendant should face court martial. That recommendation goes to the "appointing authority," an officer higher up the chain of command from the defendant.

No date has been set yet for the Article 32 hearing.

You foolish MSM parrots. The charges stem from his actions with female subordinates.

Exactly. I don't know the details, but a suggestion by a superior officer is considered a direct order in the military. This could be as simple as telling a lower ranking woman to give him head, and then afterwards she reports him.

Not a defense, just a clarification of details. People are assuming this is something it's not.

Doesn't matter what gender the victim was (in this case it was a woman)...but t hole is but t hole. What's important is that it was forced. Before you spout anti-gay stuff, look up the legal definition of sodomy. It applies to both men and women, gay and straight.

Just because at times in our history sodomy laws were interpreted broadly enough to persecute people for acts that were not sodomy does not mean sodomy does not mean sodomy under common usage.

@Mark, President Bush could have and should have stood up and kindly told the class in a calm tone that he needed to go and left especially after the first plane hit! Instead he looked like a deer in headlights which was pathetic! Yes it would not have changed the outcome of those events, but he was the leader of this country and he needed to leave that classroom and start leading period! He failed that day as a leader!

You've obviously thought this out and aren't some loony Bush-bashing liberal that would find fault with President Bush if he saved a child from drowning. Realllly.

Who is mentoring these officers???? This is appaulling to me as a SOLDIER and a citizen of the US. Seems every week I read about another officer in some sort of misconduct, either in the Army Times or a major news network. These people need stern discipline and obviously training is missing somewhere... These are the men who lead many others in peacetime and combat situations and need supervision themselves. Unreal, just really dissappointing. They say military personnel are held in high regard by the people of this great country and this repeated behavior does nothing but really dimminish the great things that many others have done!

True story: In 1994 I was working in tech support for a PC manufacturer, which involved taking a lot of phone calls. During one of the lulls in one such call while the customer and I waited for the trouble ticket system I was using (a slow database), the customer suddenly said, "Hey, you hear about Kurt Cobain?"

      "Yeah," I said. "Tragic."

      "Yeah," the customer agreed.

      There was a pause.

"It was the CIA, man," said the customer.

      "What?" I replied.

"It was the CIA," the customer repeated. "They did Kurt just like they did Del Shannon."

"Uh... huh," I said, and fortunately the database finished its business so I could get on with the actual tech support at that point. The customer didn't say anything else crazy during the rest of our conversation, but...

Nice revision of history–but obama did just that–he said he'd fix everything. Then said he deserved to only be a one termer idf he didn't fix things. 2009–huge stimulus, that was going to fix everything–it didn't, it was a disaster and huge waste, it hurt the economy by piling on more debt. Then, instead of focusing on growth and jobs, he goes all in on obamacare–dissuading people from hring due to uncertainty, higher costs, another disaster. Next, summer of 2010–he and his crew all went running around–that was going to be the summer everything was going to be turned around. Now that he's a total failure, has blown more cash than the total size of most economies, with nothing to show for it except more unemployed, he says–well I couldn't solve everything in 4 years. He's done more to screw things up in 4 years than anyone could have imagined. Gas prices doubled since obama took office–why is that Bush–no it's obama. Middle class income, down 8%–almost $5,000–that's not Bush–that's obama. This is Obama's crappy economy, quit blaming everyone else, it's obama and obama's policies that make things stink–.
And yes folks, there's lots more fun coming up if that guy gets re-elected–all the worst parts of obamacare start kicking in (conveniently) after the election. obama, the sweet guy, just thin, starting in January, we have a new tax ON WHEELCHAIRS, a new tax ON HIP REPLACEMENTS, a new tax ON HEART DEFIBRULATORS. Yes, obama the great one, so caring. For normal people, when an ederly person, amybe your mother, falls, and breaks their hip–it's tragic–for Obama–it's a taxable event.
Get los with your nonsense about obama needing enough time. He's already had too much time, and screwed things up more than anyone could have expected.

If there's enough evidence to take a BG to an Article 32 hearing, it's definitely got more traction than a nasty rumor. For things to progress to this point there would have to be a significant amount of evidence.

Media shouldn't report any arrests, only convictions. Many people are charged, only to have charges dismissed or be found not guilty. But by the time that happens, the person has been already treated as a convicted criminal by the media or the community. European media only report the first name and last name initial, a much better way.

Reminds me of another to ranking official that engaged in lewd acts. Larry Sinclair has not been scared into silence or submission in four years and he most certainly is not going to be silent in 2012. The question for all of America today is: Are you going to allow the media to continue to fool you and refuse to report the truth about Barack Obama? If the American people sit back and allow the media and the likes of Moveon, Dailykos, DemocraticUnderground, Politico, et al… scare you into silence and/or submission by calling you racist or attacking you on the Internet, then point is, Obama will never be re-elected.

    The military version of Sandusky.

Why are some people here assuming it' women trying to get ahead in their careers? The article never states male or female. If it was forced sodomy it was more than likely with males. Rape is rape no matter female/male. If he is guilty I hope he rots in hell with Jerry Sandusky.

Betty, there's absolutely no detail to go off of in this story, and the military's definition of "sodomy" is so broad as to encompass any number of acts in a variety of contexts. His conduct may be reminiscent of Sandusky's; it may reflect a different sort of behavior altogether.

Look up the legal definition of sodomy. It applies to gay or straight, men or women. In this case the victim was a woman. he's also charged with adultery and inappropriately messing around with female subordinates. Makes ya wonder why heteros can't restrain their s exual impulses.

Was this legitimate forcible sodomy? To my understanding, if you're forced to sodomize your jaw will clench shut and mace will shoot out of your fingertips and a Tea Party member will swoop in to save you.

So since that wasn't in this news article, it was not forced sodomy. No way, no how.

      An excellent point, Margaret.

It should also be keenly investigated as to whether or not the alleged victim was wearing his or her fatigues with a seductive modification, was on a third date with the general, or, perhaps, was his wife – all of which, I'm told, may cast doubt on whether or not the forcibility was, in fact, legitimate forcibility.

President Bush had the CIA on the ground in Afghanistan in a matter of days, with the US military following shortly after. The Taliban was effectively neutralized as a governing force within 30 days. I'd say that his response to the 9/11 tragedy was effective and a good display of leadership. Clinton would have lobbed two dozen Tomahawk's and called it a day.

I am wondering how this situation got this far. When women in the military are assulted or raped by a fellow soldier; virtually nothing is done about the charges or anyone punished. I guess going after the "boys" is not acceptable, but going after the girls is "OK" in the boys club.

There's no indication in any reporting that the victim was a male.

yes there is.... by not mentioning "female" it tells people it was a male. If it'd been a female her name and or rank would be there, it's too humiliating for a male to allow their name and rank broadcasted....

Has a former SAPR advocate, I can say this is not ture. It is unfortunate, however, that rape is a very diffiuclt crime to prosecute

Assuming that the victim is a man is just a reflection of your interesting fantasies or your ignorance. Google the legal definition of sodomy...it applies to men and women, gay and straight. In this case, he's also charged with adultery, inappropriate conduct with female subordinates. He's one of your team. Makes ya wonder why heteros can't restrain their s exual urges.

I bet he had lots of female E-4 and E-5 and O-1 to O-3 20 and 30 somethings who were more than willing to get ahead in their careers by meeting up with the General after work for drinks. I bet one of them wanted to ge the General to pay for her new car and when he refused, and she ran straight to the MPs.

Sadly though, he may be correct. There are people who abuse the system from both ends, so to speak, regardless of rank.

I have witnesed it in two of the units I have been in. Rules, as it would seem, are in fact made to be broken. There are very few of us that have not broken them. We are indeed the minority.

So you're certain the victims were not male soldiers?

He's also charged with inappropriate relations with female subordinates and adultery. We can assume the sodomy victim was also a woman. The legal definition of sodomy applies to both men and women, gay and straight.

Here is a thought....he could be innocent. When do looks determine guilt? Hang him, then sent him to trial....good call.

I agree with Jess on this one.

Although for the proceedings to get this far against a general officer, the evidence must be pretty significant.
