Ft. Hood shooter trial delayed

A military appeals court halted the murder case against Maj. Nidal Hasan indefinitely on Friday to sort out issues surrounding a judge's threat to shave the beard the Army psychiatrist grew while awaiting trial in the 2009 Fort Hood killings.

The court martial was originally stopped on Wednesday and Hassan was fined $1,000 for remaining bearded, which violates Army regulations. The military judge in the case, U.S. Army Col. Gregory Gross, had previously held that Hassan's beard disrupts the court proceedings and held him in contempt of court five times, the Army said in a news release.

Hasan's court-martial had been scheduled to start Monday at Fort Hood, in Killeen, Texas, where he is accused of killing 13 people and wounding another 32. Gross, had threatened to have him forcibly shaved unless he got rid of the beard on his own.

It was unclear how long the case would be on hold.

Hasan had been expected to enter a plea during a Wednesday hearing, but the proceedings were halted by the appellate court. Hasan has previously expressed interest in pleading guilty, but military regulations bar a judge from accepting a guilty plea in a capital case.

Hasan is accused of opening fire at the post's processing center, where soldiers were preparing to deploy to Afghanistan and Iraq, in November 2009. The stay came the same day he was expected to enter a plea to the charges against him.

The issue surfaced in June, when a bearded Hasan - who remains in the Army while awaiting trial - appeared at a June hearing. Gross postponed that hearing, found Hasan in contempt of court at a July hearing, fined him $1,000 and warned him he would be shaved by force unless he got rid of it.

Hasan faces a possible death sentence if convicted. He was paralyzed from the waist down when police officers exchanged fire with him.

His lawyers had been seeking a delay of the case until December, but Gross refused and set Monday as the trial date.

Hasan, a U.S.-born citizen of Palestinian descent, who joined the Army in 1997. He had been scheduled to deploy to Afghanistan before the killings, but had been telling his family since 2001 that he wanted to get out of the military.

The Muslim psychiatrist had told his family he had been taunted after the terrorist attacks of September 11, 2001. Investigations that followed the killings found that he had been communicating via e-mail with Anwar al-Awlaki, the Yemeni-American radical cleric killed by a U.S. drone attack in 2011.

An FBI report in July found that a Joint Terrorism Task Force in San Diego that was investigating al-Awlaki passed two of the messages to another task force in the Washington area, where Hasan was then living. The report found those e-mails should have been passed to the Pentagon - but the FBI saw no evidence of terrorist activities in his case, believed the information in the e-mails was too sensitive to share and noted that visiting extremist websites is not grounds for taking action.

    I am related to one of the victims of Fort Hood. I don't give a crap what his religious beliefs are or what he feels they should allow. He is a murderer he should have no rights, religious or not. It's a waste of time and money to allow this to continue. Find him guilty and shoot his paralyzed ass! Closure is needed by the victims' family, we have waited too long and it will not be closed until justice is served!

    This 'Officer' is in violation of regulations he has sworn to uphold. Does that suprise anyone? Why should he shave? He has murdered his own comrads wearing the same uniform. Do you really think he is concerned with a violation of Army Regulations and a thousand dollar fine?? Hardly. Assign this wanna be terrorist a team of people to forcably remove his beard with tweezers if he refuses to shave and stop waisting tax dollars on these games. Are the men selected for the military firing squad selected yet or do we have to wait months for that too. Send this filth to his eternal damnation and get it over with.

    The guy is still in the military. Being clean shaven is still the standard, right? Make him shave! We ensure that PVT's shave everyday. This guy is in custody for murder, he doesn't get to choose anything anymore. The gov't is wasting time and money on a sub-standard soldier because they don't want to hurt his feelings. Get on with it!

    Is he still getting paid? Unless he has been tried, convicted and sentenced he is still a major and collects a major's pay (minus BAH and BAS since he is being quartered in jail) and that is a significant amount of money. Why isn't there more outrage about this? I thought he slaughtered his victims in Texas, the state Ron White claims is putting in an express lane for executions while other states are doing away with capital punishment. Oh right, Hassan is being tried by the Federal Government, not the state of Texas. Can we change that–the Federal Government couldn't run a water faucet correctly these days.

Just sedate the idiot and shave off the beard while he's sleeping–why do we need a trial for this slime anyway? I really don't think there is ANY doubt in the minds of the witnesses and survivors of this creton's violence about his guilt. Are we seriously THAT messed up? Oh, wait, we elected Obama and may re-elect him–never mind...

    So, justice is delayed because he has a beard? A BEARD? Really? Grant had a beard, Sherman and Lee had beards. It did not stop anyone from doing anything. Apparently, there is more going on here. Perhaps the best way to keep him in jail and out of the press is to keep putting off his trail until he is no longer interesting. After all, in a wheel chair for the rest of his life is not a bad start.

    The judge should have set all military rules, in complied military order before trial, "shaved and in Military uniform, and secured," I'am sure these rules are written, in the U.M.C.J. lets take a look and see.

    Sorry, but personally I believe the traitor should be tried as is. Apparently, this Judge is a "by the book" officer who wants the accused to appear in full dress uniform and groomed accordingly. Since the defendant is paralyzed from the waist down and probably has no control over some bodily functions, this whole point is probably moot. Get on with the court martial and lets put this sordid crime in the history books!
