The military judge who will oversee the trial of the man accused in the 2009 Fort Hood massacre ruled Wednesday that if Maj. Nidal Hasan doesn't shave by the start of jury selection, he will be forcibly shaved.
Col. Gregory Gross has been telling Hasan he must shave, in accordance with Army regulations. Hasan, who is a Muslim, has refused to shave for more than a month, apparently in keeping with Quranic teachings.
During a pretrial hearing Wednesday, Gross ruled Hasan in contempt of court and fined him $1,000. Gross told Hasan that he unless the defendant shaves before the start of his trial, he will be "forcibly shaved," according to Christopher Haug and Tyler Broadway, spokesmen at Fort Hood.
Even though Hasan has been in custody since November 2009 when 13 people were shot and killed at the U.S. Army installation outside Killeen, Texas, he is still in the Army and still draws his pay.
Hasan was left paralyzed from the waist down in the shooting, when police officers exchanged fire with him. He faces a possible death penalty if convicted in the shooting.

Yes, people in military confinement still get paid, often at a very reduced rate like Pvt1. Forcible shaving is the wrong approach. If shaving is against Islam fine, there however is no objection to the death penalty in Islam.

The point is that, regardless of what his religion is, he is a comissioned officer in the US military, and is subject to the UCMJ. PERIOD. He knew this when he became an officer, and has complied with regulations until this point... he was already a practicing Muslim, and shaved regularly, and it was 'OK' then. Refusing to shave now (and blaming it on his religion) is a simple case of noncompliance and insubordination, and it's not surprising he got a contempt charge, too... The reason he's allowed to draw pay is the same exact reason why they can(should) hold him down and shave him by force, if necessary – because he is still an active member of the military and his rights and conduct are governed by the UCMJ. One way or the other, I agree with a few other people commenting here today... if you really want this guy to probably get closer to what he's got coming, you do NOT want civilian courts to touch this. Well, see we have this thing about being innocent until proven guilty. Now what will probably happen is once found guilty and reduced to rank E1 until sentencing and execution if so ordered that reduction will be retroactive to the time of his arrest. All funds would be seized at that time. They have to let him stay enlisted because if the discharge him he will not fall under military authority then it would transfer to civilian courts. He's an officer in the military and they have rules on how you are to look (IE: hair cut, shaved, dress....) you can get premission to not shave but that even has a rule that it can only be so long. Remember he signed on that line and agreeded to these rules. Make the man act as he agreeded.
He has been in custody since 2009 and ONLY since last month has not been shaving, this obviously is not part of his faith. That's what I was thinking??!! There are people in this country that can't draw unemployment for that long that really need it, but our government is still paying him?? I'm confused here. It's not like they don't know if he is guilty or not! They caught him in the act. I mean damn. This is going to make crooks want to join the military even more. Knowing they can commit crimes while in the military and still get paid. SMDH!!
He is in the military and as such he is to obey the orders of his superiors, no matter his religion. If he had religious qualms about the military, then why did he join?

Maybe someone can clarify this but why in the hell is he still drawing Army pay???? This happened in 2009. 3 GD years ago. While awaiting trial, could he have not been Dishonorably Discharged? Seems pretty simple to me. It's either now or after the trial, what's the difference. Don't tell me they will execute him and he's still apart of our Armed Services!!!!!!!!
Innocent until proven guilty. Clearly he is guilty, but it still has to follow the judicial process. Therefore, he is still under contract with the Army. Just how it works.
